Maģistra darba „Daudzdzīvokļu nama un zemes dalītā īpašuma izbeigšanas veidi” mērķis ir apskatīt līdzšinējo dalītā īpašuma izbeigšanas tiesisko regulējumu, pastāvošo problēmu cēloņus un risinājumus, kā arī izanalizēt topošā likumprojekta saturu kopsakarā ar izvirzītajiem priekšlikumiem dalītā īpašuma izbeigšanā, apzinot pastāvošas problēmas un meklējot ieteikumus to risināšanai. Dalītā īpašuma problēma saistīta ar apstākli, ka šis tiesību institūts tā radīšanas brīdī tika plānots, kā pagaidu variants ar mērķi to nākotnē izbeigt. Taču līdzšinējais tiesiskais regulējums nav bijis gana sekmīgs, lai veicinātu dalītā īpašuma izbeigšanu, kā vienu no galvenajām problēmām iezīmējot sarežģīto situāciju daudzdzīvokļu namu un zemes dalītā īpašuma gadījumos. Izdalot šo dalītā īpašuma veidu, novērojamas gan jaunas aktuālas tendences līdzšinējā regulējuma interpretācijā, lai panāktu dalītā īpašuma izbeigšanu, gan aktīvi norisinās darbs un diskusijas pie likumprojektiem, kuri gan palīdzētu izbeigt dalīto īpašumu, gan normalizētu namu un zemju īpašnieku savstarpējās attiecības. The aim of Master's Thesis „Multi-apartment building and land divided property termination ways” is to examine the existing legal framework of termination divided property, to examine causes and solutions of existing problems, as well to analyze the continent of the prospective draft law in conjunction with the proposals for divided property termination, identifying existing problems and seeking recommendations for their solution. Divided property problem relate to the fact that this Law Institute at the time of its creation was planned as a temporary option with an aim to end it in the future. However, the current legal framework has not been successful enough to encourage the divided property termination, highlighting the difficult situations in the cases of multi-apartment houses and land divided property. By displaying this type of divided property, there are new current trends in the interpretation of the existing legal framework in order to terminate divided property. As well active work and discussions are taking place on draft laws that would both help put an end to divided property and also normalize the relationship between home and land owners.
