Eiropas Savienības privāttiesiskā regulējuma ietvaros sabiedriskās kārtības (ordre public) klauzula dod iespēju tiesai atteikt ārvalsts tiesas sprieduma izpildi vai kolīziju normu rezultātā noteiktā ārvalsts likuma piemērošanu, ja tā piemērošanas sekas ir pretrunā ar tiesas valsts sabiedrisko kārtību. Eiropas Savienības tiesa veic sabiedriskās kārtības interpretāciju un lai gan nav tiesīga noteikt dalībvalstu sabiedriskās kārtības saturu, tomēr tā var prasīt pārskatīt robežas, kurās dalībvalstu tiesas var izmantot šo atteikumu. Autors darba ietvaros pēta sabiedriskās kārtības jēdzienu Latvijas un Eiropas Savienības privāttiesībās, salīdzina tiesu praksi, lai secinātu vai Latvijas tiesu prakse atbilst Eiropas Savienības tiesas noteiktajām vadlīnijām, un definē pamatus ordre public piemērošanai. Within the framework of the European Union private international law, the public policy (ordre public) clause allows the court to refuse the recognition and enforcement of a foreign court judgment or the application of a foreign law, determined by the conflict of law rules, if the consequences of its application are in contrast with the public policy of the forum state. The Court of Justice of the European Union carries out an interpretation of the public policy clause and, although it is not entitled to determine the content of public policy of each member state, it may, however, review the limits at which the courts of the Member States may use that refusal. The author examines the notion of public order in private law of Latvia and the European Union, compares jurisprudence in order to conclude whether the Latvian court practice complies with the guidelines established by the European Court of Justice and defines the grounds for application of ordre public.
