Valsts un baznīcas attiecību politika

Abstract

Maģistra darba temats ir “Valsts un baznīcas attiecību politika”, kura mērķis ir sniegt ieskatu valsts attiecībās ar reliģiskajām savienībām (baznīcām), šo attiecību ietekmējošiem tiesiskajiem un politiskajiem aspektiem kopsakarā ar reliģijas brīvības tiesību nodrošināšanu, kas paredzēta Satversmes 99. pantā. Maģistra darbā tiek analizēti valsts un baznīcas attiecību tiesiskie pamati un modeļi, kā arī Satversmes tiesas 2018.gada 26.aprīļa sprieduma Nr. 2017–18–01 ietekme uz normatīvo regulējumu reliģisko organizāciju jomā. Izpētes rezultātā sniegts ieskats par Latvijā vēsturiski izveidojušos valsts un atsevišķo reliģisko savienību (baznīcu) tiesiskā regulējuma izstrādi, tā ietekmi, kā arī piedāvāti turpmākie risinājumi valsts un baznīcas savstarpējo attiecību politikas sekmēšanai, saskaņojot tos ar esošajiem tiesību aktiem un šobrīd izveidojušos attiecību politiku ar reliģiskajām savienībām (baznīcām), kā arī paredzot iespējamos normatīvo aktu grozījumus.

he title of this study is "The relationship politics between the state and the church". The purpose of this study is to serve as a glance into government’s relations with religious associations such as churches, into affecting law and political aspects, parallel with religious freedoms rights, which are covered in the Article 99 of the Constitution of the Republic of Latvia. The study analyses the lawful relationship basis between the states and churches, their relationship models and judgment of Constitutional Court of Republic of Latvia in case No. 2017 – 18 – 01 and how it affects regulation of the religious organisations. The study also provides insight into the development of the legal framework of the country and the individual religious associations (churches) that have historically formed in Latvia, as well as proposes further solutions for promoting the policy of mutual relations between the state and the church, harmonizing them with the existing legislation and the policy of relations with religious associations that have now formed (for churches), as well as foreseeing possible amendments to the regulatory enactments
