Zemes gabala telpiskās norobežotības problemātika.

Abstract

Bakalaura darba “Zemes gabala telpiskās norobežotības problemātika” mērķis ir izpētīt un analizēt problēmas, kas rodas zemes gabala robežu noteikšanas un jau esošo robežu pārmērīšanas procesā, lai izprastu, ar kādām normatīvā regulējuma problēmām var saskarties tiesību piemērotāji, konstatējot, ka konkrētā zemes gabala robežas neatbilst to vēsturiskajam plānam vai ir nepareizi noteiktas dabā. Pēc darba autora domām darba aktualitāte ir saistīta ar to, ka Latvijas Republikas normatīvajos aktos ir vairākas problēmas, kas nepārprotami ietekmē zemes gabala telpisko norobežotību un ar to radušos robežstrīdu atrisināšanu, kā rezultātā personām ir liegta iespēja panākt savu īpašuma tiesību saprātīgu aizsardzību. Izskatot zemes gabalu robežu noteikšanas un normatīvā regulējuma principus, nacionālo regulējumu un tiesu praksi, darba autors secināja par zemes gabala robežu noteikšanas procesu un tās problemātikas rašanās cēloņiem. The aim of the bachelor’s work on “Problems of Spatial Delimitation” is to investigate and analyse problems arising from the land-parcel borders and from the process of remeasuring existing borders, in order to understand the regulatory challenges that law enforcement may face, by finding that the boundaries of a given parcel do not correspond of their historical plan or are incorrect defined in nature. According to the author of the work, the spotlight of the work is realed to the fact that there are number of problems in the regulatory eneactments of the Republic of Latvia, which clearly affect the spatial delimitation of the parcel and the resolution of the border disputes resulting therefrom, which prevents persons from obtaining the possibility of thei ownership rights. Looking at the principles of land borders and regulatory framework, national regulation and judical practice, the author of the work drew up a series of conclusions on the process of setting land borders and the causes of its problem.
