Bakalaura darba “Izmeklēšanas tiesnesis kā amatpersona, kas pilnvarota veikt kriminālprocesu” mērķis ir izpētīt izmeklēšanas tiesneša institūtu kriminālprocesā un konstatēt problēmjautājumus normatīvajā regulējumā, kas reglamentē izmeklēšanas tiesneša darbību Latvijā, sniedzot iespējamos juridiskos risinājumus. Darbā tiek pētīti tādi jautājumi kā kriminālprocesa saikne ar personas pamattiesībām, izmeklēšanas tiesneša kā amatpersonas pilnvaras un nozīme kriminālprocesā, uzsvaru liekot uz amatpersonas nozīmi izmeklēšanas darbībās un procesuālo piespiedu līdzekļu piemērošanā. Īsi tiek apskatīti ārvalstu kriminālprocesuālie regulējumi, lai konstatētu vai šāda amatpersona tiek paredzēta arī citu Eiropas valstu kriminālprocesos. Pētījuma gaita tiek konstatēts, ka pašreizējais kriminālprocesuālais regulējums satur nepilnības attiecībā uz cilvēktiesību nodrošināšanu un to ierobežošanas kontroli, tādēļ tiek izvirzīti priekšlikumi attiecīgo normatīvo aktu grozījumiem. The aim of the Bachelor Thesis “Investigating judge as an official in Criminal procedure” is to research the institute of investigating judge in criminal proceedings, identify issues in the regulatory framework that regulates the activities of the investigating judge in Latvia and to provide the possible legal solutions. In this Bachelor Thesis are being studied topics like connection between criminal proceedings and fundamental rights of the person, the powers and the role in the criminal proceedings of the investigating judge as an official, putting emphasis on the role of the official in pre- trial inquiry and the application of procedural coercive measures. Foreign criminal procedural regulations are briefly overlooked to establish whether such an official is also intended in other European countries. The author has come to the conclusion that Latvian Criminal procedure law contains shortcomings regarding the protection of human rights and to the control of their restriction, therefore proposals are made for amendments of the relevant regulatory enactments.
