Līdzīgus tiesiskus institūtus regulē divi likumi – Iesniegumu likums un Informācijas atklātības likums (turpmāk – likumi). Vienlaikus abus likumus nevar piemērot, jo tie ir savstarpēji izslēdzoši. Nošķiršanas jautājums ir svarīgs, jo katrs likums paredz dažādus termiņus atbildes sniegšanai un dažādu pārsūdzības kārtību. Darba mērķis ir noskaidrot, vai ir iespējams nošķirt Iesniegumu likumu no Informācijas atklātības likuma. Lai sasniegtu mērķi autore izvirzīja šādus uzdevumus: apskatīt iesniegumu tiesību un tiesību iegūt informāciju saturu, aplūkot iesniegumu tiesību regulējumu ārvalstu normatīvos aktos, noskaidrot Iesniegumu likuma un Informācijas atklātības likuma nošķiršanas nepieciešamību, likumu subjektus, objektus, mērķus un izpētīt Latvijas tiesu praksi attiecībā uz likumu nošķiršanu. Autore secina, ka praksē ir pamatotas grūtības nošķirt likumus un pašreizējais tiesiskais regulējums tikai formāli paredz nošķiršanas kārtību, tāpēc autore piedāvā novērst likumu atšķirības, kā arī universālus likumu nošķiršanas kritērijus. Similar legal institutes regulates are regulated by two laws – Law on Submissions and Freedom of Information Law (further – laws). It is impossible to apply these two laws at the same time because one law excludes the other. The question of the distinction between the two laws is important because each law regulates a different response term and a different appeal process. The aim of the research is to find out if it is possible to distinct Law on Submissions from Freedom of Information Law. In order to achieve the goal, the author assigned the following tasks: inspect petition law and principle of freedom of expression content, analize foreign states petition law legal regulation, find out why there is a need to distinct laws, the subjects, objects and aims of the laws, and research Latvian courts practice for distinction of the two laws. The author of the bachelor paper has come to a conclusion that, in practice, it is difficult to distinct the two laws and the existing legal regulation assumes a distinct order only formally, and thus the author poses an offer to remove the difference and develop a universal criteria for the distinction of the two laws.
