Apdrošināšanas līgumu var slēgt par vairākiem apdrošināšanas objektiem, savukārt Krimināllikuma speciālā norma, kas paredz kriminālatbildību par apdrošināšanas krāpšanu, aptver tikai vienu no šiem apdrošināšanas objektiem, proti, mantu. Kā pētījuma mērķi autors norāda apdrošināšanas krāpšanas sastāva pamatpazīmju analīzi un ar tām saistīto problēmjautājumu identificēšanu. Mērķa sasniegšanai autors izpētīs apdrošināšanas vēsturi, tās pašreizējo civiltiesisko regulējumu Latvijā, kā arī veiks apdrošināšanas krāpšanas sastāva elementu analīzi, ko skatīs kopsakarā gan ar tiesu praksi, gan ar tiesību doktrīnu. Pētījuma rezultātā autors norāda uz to, ka civiltiesiskais apdrošināšanas objektu loks ir plašāks nekā speciālās krāpšanas normas (apdrošināšanas krāpšana) tvērums, kā arī tiek identificēti problēmjautājumi, kas saistīti ar šī noziedzīgā nodarījuma sastāva pamatpazīmēm un piedāvāti iespējamie grozījumi. It is possible to sign an insurance contract that covers one of many possible insurance objects, however the special norm of the Criminal Law of the Republic of Latvia, which is the basis for criminal liability, specifically for insurance fraud, covers only one of many possible insurance objects - property. The goal of the study is to analyze the regulation of insurance fraud and to identify the problems regarding this specific regulation. To reach the above mentioned goal, the author will research the history of insurance and the current civil regulation of insturance in Latvia. Also the author will analyze the current reglamentation of insurance fraud, which will be researched in conjunction with the existing insurance fraud cases and doctrine. At the end of the study, the author indicates that the possible civil insurance object field is wider than the special fraud norms (insurance fraud) scope. Also, the author, has identified the main problems in regards to the current regulation of insurance fraud and has proposed an amendment to the current regulation.
