dc.description.abstract | Bakalaura darba “Aktuālā Eiropas Savienības Tiesas judikatūra Eiropas Aresta ordera lietās” mērķis ir izpētīt astoņus nozīmīgus Eiropas Savienības Tiesas spriedumus Eiropas Aresta ordera lietās. Ievērojot minēto, bakalaura darbs sniedz ieskatu Eiropas Savienības Tiesas nesenajos spriedumos, kuros skaidroti Padomes Pamatlēmumā par Eiropas Aresta orderi un par nodošanas procedūrām starp dalībvalstīm ietvertie jēdzieni “tiesas nolēmums” un “tiesu iestāde”, kā arī aplūkoti Pamatlēmumā ietvertie Eiropas Aresta ordera neizpildes pamati un Eiropas Aresta ordera ietekme uz personas pamattiesībām. Darba ietvaros Autore akcentē galvenos problēmjautājumus Eiropas Aresta ordera piemērošanā un analizē savstarpējā atzīšanas principa piemērošanas robežas. Autore galvenokārt izmantojusi literatūru angļu valodā, analizējusi Eiropas Savienības Tiesas praksi un aplūkojusi nevalstisko organizāciju ziņojumus. Pētījuma rezultātā Autore konstatē pamattiesību ietekmi uz aktuālo Eiropas Savienības tiesas judikatūru un uz izpildes dalībvalsts pienākumu izpildīt saņemto Eiropas Aresta orderi, kā arī nepieciešamību ieviest obligātu proporcionalitātes principa piemērošanu. | |
dc.description.abstract | Aim of bachelor’s thesis “Recent developments in the case-law of the Court of Justice of the European Union in European Arrest warrant cases” is to research eight influential judgements of the Court of Justice of the European Union in European Arrest warrant cases. Considering the aforementioned, bachelor’s thesis provides an insight in recent case-law of the CJEU that delivers interpretation on legal terms “an arrest warrant” and “issuing judicial authority”, an overview of non-execution grounds listed in the Framework decision is provided and European Arrest warrant’s impact on person’s fundamental rights examined. Author has determined the main problematic aspects of European Arrest Warrant’s mechanism and Author has analysed limits of application of the mutual recognition principle. The author has mainly used literature in English, analysed judgements of the Court of Justice of the European Union and studied reports from non-governmental organisations. As a result of this research, the Author identified fundamental right’s impact on recent case-law of the Court of Justice of the European Union and the impact on executing state’s duty to execute received European Arrest warrant, moreover, the Author concluded the necessity of introducing a mandatory proportionality check.
