Direktīvas 2004/35/EK ieviešanas problēmas Latvijā: fizisko personu un operatora atbildības praktiskie aspekti un būtiskuma slieksnis

Ņemot vērā vides atbildības korektas piemērošanas nozīmi mūsdienu situācijā, darba mērķis ir izvērtēt Direktīvas 2004/35/EK ieviešanas problemātiku Latvijā saistībā ar atbildības subjektu un būtiskuma slieksni. Tādējādi darba uzdevums ir sākotnēji izpētīt Direktīvas 2004/35/EK izpratni Latvijas tiesību sistēmā, analizējot tās materiāltiesisko, personu un laika tvēruma robežas. Tālākajā darba gaitā tiek aplūkoti ar direktīvu ieviestie jauninājumi Latvijas vides tiesību jomā salīdzinājumā ar iepriekš pastāvošo regulējumu. Darba praktiskajā daļā tiek turpmāk izvērsta operatora tiesiskā regulējuma attiecināšana uz fizisku personu, kā arī būtiskuma sliekšņa problemātika. Secināms, ka Latvija direktīvas ieviešanas gaitā nav atbilstoši izvērtējusi nepieciešamību pēc diferencēta regulējuma attiecībā uz fizisku personu, kas neveic saimniecisku darbību. Ņemams vērā, ka ar būtiskuma kritēriju saistītās problēmas iespējams novērst nevis ar vadlīniju palīdzību, bet gan ar valstu tiesu prakses analīzi un apkopošanu. Tomēr šobrīd, ierobežoti pieejamās valstu prakses piemēru pieejamības dēļ, ir ierobežota šī kritērija izpratnes veidošanās. Taking in to account the importance of applying environmental responsibility correctly in today’s situation, the aim of the work is to assess the problem of implementation of Directive 2004/35/EC in Latvia in relation to the subject of responsibility and the significance threshold. Thus, the task of the work is to initially examine the understanding of Directive 2004/35/EC in the Latvian legal system by analyzing the limits of its material, personal and temporal scope. In the course of further work, the innovations introduced by directive in Latvian environmental law are considered in comparison with the pre-existing regulation. The practical part of the thesis further deals with application of operator’s legal framework to natural person, as well as problematic aspects of significance threshold. It can be concluded that Latvia has not adequately assessed the need for a differentiated regulation for a natural person, who doesn’t perform occupational activity during the implementation of the directive. It should be noted that problems related to the significance threshold can be solved not by means of guidelines, but by analysis and compilation of national case law. However, at present, due to the limited availability of national practice examples, there is limited comprehension of this criterion.
