Bakalaura darbā autors ir pētījis preču zīmju tiesību pārkāpumu un negodīgas konkurences aizlieguma mijiedarbību Latvijā. Darbā tiek pētītas preču zīmes, preču zīmju tiesību pārkāpumi, negodīga konkurence un negodīga konkurence attiecībā uz preču zīmju tiesību pārkāpumiem. Bakalaura darba mērķis ir noteikt priekšnoteikumus preču zīmju tiesību pārkāpumam un negodīgas konkurences aizlieguma pārkāpuma attiecība uz preču zīmēm, tiesību subjektus, kas var celt negodīgas konkurences prasību saistībā ar preču zīmju tiesību pārkāpumu un noteikt atšķirības starp šiem diviem tiesību institūtiem. Bakalaura darba mērķa sasniegšanai autors ir izvirzījis uzdevumus: •Analizēt preču zīmju jēdzienu; •Izpētīt preču zīmju tiesību pārkāpumus; •Izpētīt negodīgas konkurences jēdzienu; •Analizēt preču zīmju tiesību pārkāpumu un negodīgas konkurences savstarpējo attiecību. Bakalaura darba izstrādē autors ir secinājis, ka: 1)Konkurences likuma 18. panta otrajā un trešajā daļā jāaizstāj vārdi “cita tirgus dalībnieka” ar vārdiem “citas personas”, tāpēc, ka pašreizējā redakcija nenodrošina pilnvērtīgu konkurences aizsardzību gadījumos, kad tirgus dalībnieks izmanto vai atdarina preču zīmi, kuras īpašnieks Latvijā saimniecisko darbību neveic; 2)Prasību par Konkurences likuma 18. panta otrajā un trešajā daļā paredzētajiem negodīgas konkurences aizlieguma pārkāpumiem primāri var celt tirgus dalībnieks, kura tiesības uz godīgu konkurenci ir pārkāptas; 3)Preču zīmju tiesību pārkāpumi un negodīgas konkurences izpausmes ir līdzīgas, bet tomēr starp tiem pastāv būtiskas atšķirības; 4)Negodīgas konkurences aizlieguma prasības aizsargā arī nereģistrētas preču zīmes. The author of the Bachelor's thesis has studied the interaction of trademark rights violation and the prohibition of unfair competition in Latvia. Trademarks, trademark rights violations, unfair competition, unfair competition for trademark infringement are investigated. The aim of the bachelor's thesis is to determine the preconditions for finding trademark infringement and for unfair competition prohibition violation in regards to trademarks, the right holders who can bring an unfair competition claim in connection with infringement of trademark rights, and determine the differences between the two institutes of law. In order to achieve the goal of the Bachelor's work the author has set tasks: •Analyse the concept of trademarks; •Explore trademark rights violations; •Explore the concept of unfair competition; •Analyse the relationship between trademark infringement and unfair competition. The author has concluded that: 1)In the second and third paragraphs of Article 18 of the Competition Law, the words “other market participant” shall be replaced by the words “other persons”, because the current wording does not ensure full protection of competition in cases when a market participant uses or imitates a trademark owned by person who do not conduct economic activity in Latvia; 2)An infringement of the prohibition of unfair competition laid down in the second and third paragraphs of Article 18 of the Competition Law may primarily be brought by a market participant whose right to fair competition has been infringed; 3)There are similarities between infringements of trade mark rights and unfair competition, but there are still significant differences between them; 4)Unfair competition claims also protect unregistered trademarks.
