Pielaides kārtība valsts noslēpumam un tās tiesiskie aspekti Latvijā

Abstract

Bakalaura darbs „Pielaides kārtības valsts noslēpumam un tās tiesiskie aspekti Latvijā” sniedz ieskatu valsts noslēpuma aizsardzības un speciālās atļaujas pieejai valsts noslēpumam regulējumā un tā problemātikā. Darba mērķis ir izpētīt speciālās atļaujas pieejai valsts noslēpumam tiesisko regulējumu, kā arī apskatīt problēmjautājumus, ar kuriem nākas saskarties personu drošības pārbaužu procedūrā. Darba ietvaros autors veic izpēti, kā arī konstatē trūkumus un nepilnības Latvijas Republikas tiesiskajā regulējumā par valsts noslēpuma aizsardzību. Šobrīd spēkā esošais normatīvais regulējums tiek salīdzināts ar vēsturisko regulējumu, kā arī ar citu valstu pieredzi valsts noslēpuma aizsardzības jomā. Darba ietvaros autors sniedz redzējumu un izvirza priekšlikumus normatīvo aktu uzlabošanai personas drošības pārbaudes procesam, valsts drošības iestāžu lēmumu nepiešķirt personai speciālo atļauju pārsūdzēšanas procesam, kā arī sniedz redzējumu valsts augstāko amatpersonu iespējai saņemt automātisku speciālo atļauju pieejai valsts noslēpumam.

The Bachelor's thesis “Access to state secrets and its legal aspects in Latvia” provides insight into the state secret regulation and the access to state secret regulation and its problems. The aim of the research is to study the legal framework of the special permit for access to state secrets, as well as to look at the issues that have to be dealt with in the procedure of security checks of persons. In the Bachelor’s thesis the author carries out research, as well as finds problematic in the legal regulation of the Republic of Latvia on protection of state secrets. The current normative regulation is compared with the historical regulation, and the normative regulation of Latvia is compared with the experience of other countries in the field of protection of state secrets. In the research of the thesis, the author presents a vision and makes proposals for the improvement of the normative acts for the process of personal safety inspection, the decision of the state security institutions not to grant a person a special permit for the appeal process, as well as provides the vision for the possibility of parliament members, President of the State and Prime Minister to receive automatic special permission to access state secret.
