Saeimas deputāta zvērests - tā došanas procesuālie aspekti

Abstract

Zvēresta nodošana parlamenta locekļiem, uzsākot pildīt tautas priekšstāvja pienākumus, ir sena tradīcija, taču tā Latvijas Republikas Satversmē nostiprināta salīdzinoši nesen. Dažādās valstīs atšķiras gan parlamenta locekļu zvēresta formas, nodošanas procesuālā kārtība, ar to saistītais regulējums, kā arī tradīcijas. Analizējot Saeimas deputāta zvēresta nodošanas tiesību institūtu, var izdalīt procesuālos un materiālos aspektus. Tā kā Saeimas deputāta zvērests ir plašs, bakalaura darbs izstrādāts, analizējot Saeimas deputāta zvēresta nodošanas procesuālos aspektus, atsakoties no materiālajiem aspektiem. Bakalaura darbā pētīta Saeimas deputāta zvēresta nozīme un vēsturiskā attīstība, analizēti zvēresta nodošanas procesuālie aspekti – zvēresta nodošanas procesuālā kārtība, sekas, ja deputāts atsakās no zvēresta nodošanas, kā arī zvēresta forma un tās ievērošanas nozīme. Šajā pētījumā autore veikusi parlamenta locekļu zvēresta nodošanas procesuālo aspektu Latvijā un citās valstīs salīdzinošo analīzi.

It is an ancient tradition for members of the parliament to take an oath before they can undertake their duties at the parliament. The oath of Member of the Saeima has been implemented in the Satversme relatively recently. There are differences in processual aspects and traditions of giving the oath, and the form of oath compared between various countries abroad. There are processual and also material aspects of oaths of members of parliament. Taking in consideration oath’s of Member of the Saeima complexity, in this Bachelor thesis the author analyzed only the processual aspects, excluding the material aspects. The Bachelor’s thesis consists of research about meaning and development history of the oath of Member of the Saeima; analysis of the processual aspects of taking the oath − the processual order of taking the oath, consequences of refusing to take the oath, the importance of complying with the form of oath. This thesis contains comparative analysis of procedure of taking the oath of parliament members established in Latvia and various states abroad.
