Tiesiskās aizsardzības procesa attīstības šķēršļi un pilnveidošanas iespējas.

Abstract

Tiesiskās aizsardzības procesu regulējošais Maksātnespējas likums ir vairākkārt grozīts kopš tā pieņemšanas, bet vēlamo rezultātu, t.i. ievērojamu skaitu komersantu, kas izbeidzot tiesiskās aizsardzības procesu, atjauno maksātspēju, nav sniedzis. Bakalaura darba “Tiesiskās aizsardzības procesa attīstības šķēršļi un pilnveidošanas iespējas” mērķis ir noskaidrot šķēršļus tiesiskās aizsardzības procesa piemērošanā un regulējuma attīstībā Latvijā, apskatīt Zviedrijas, Vācijas, ASV praksi un regulējumu šo pašu jautājumu risināšanā, kā arī Eiropas Savienības regulējuma attīstības tendences attiecībā uz maksātnespējas regulējumu un kā tas ietekmēs Latvijas regulējumu. Pētāmas problēmas aktualitāte – saskaņā ar statistikas datiem, tikai 3-4% no pasludinātajiem maksātnespējas procesiem beidzas ar plāna izpildi. Bakalaura darbs sastāv no trīs nodaļām, kas iedalītas apakšnodaļās. Pirmajā nodaļā apskatīta tiesiskās aizsardzības procesa būtība un jēdzieni, katras valsts īpatnības regulējumā, kā arī salīdzināta pieejas efektivitāte atsevišķu jautājumu risināšanā. Otrajā nodaļā apskatīta Latvijas regulējuma attīstība, kā arī Eiropas Savienības topošo un esošo normatīvo aktu analīze un ietekme uz Latvijas regulējumu. Trešajā nodaļā aplūkotas lielākās Zviedrijas, Vācijas un ASV pārstrukturēšanas lietas, kā arī izsecināti veiksmīga iznākuma elementi un iemesli. Bakalaura darba nobeigumā tiek izvirzīti secinājumi un priekšlikumi. Darbā tika izmantoti 42 literatūras avoti, tostarp normatīvie akti, judikatūra, doktrinālie avoti, periodika. Darba apjoms ir 48 lapas.

The Insolvency Law which regulates the legal protection proceedings has been amended multiple times since its enactment, but they have not achieved the desired effect, i.e. a greater number of businesses that upon ending legal protection proceedings, regain their solvency. The aim of the Bachelor thesis “Legal protection proceedings – hindrances to development and options for improvement” is to ascertain the obstacles that face the regulation and application of legal protection proceedings in Latvia, view the regulation and practice of Sweden, Germany, the US in these same areas, as well as determine the direction of the European Union in regulating insolvency and how it will impact Latvian regulations. Relevance of issue – according to statistical data, only 3-4% of commenced legal protection proceedings end with the fulfilment of the plan. The bachelors’ thesis consists of three chapters, divided into subchapters. In the first chapter, the essence and elements of the legal protection proceeding are analyzed, each countries’ unique details in regulations, as well as a comparisson of effectiveness in resolving distinct issues. In the second chapter, the development of Latvian regulations are analyzed, as well as the effect of the current and forming regulations of the European Union on the regulations of Latvia. In the third chapter, the biggest restructuring cases of Sweden, Germany and the US are analyzed, reasons and elements of success are then ascertained. In the ending of the Bachelor’s thesis, conclusions and proposals are formulated. 42 sources of literature, among them regulatory enactments, case law, doctrine, and periodicals are used in the work. The volume of the work is 48 pages.
