Mantojuma masas apsardzība un aizgādnība

Abstract

Mantojuma aizgādnības un mantojuma apsardzības institūti ir regulēti vienā Civillikuma nodaļā – piektās nodaļas otrajā apakšnodaļā (657.-666.pants), tādēļ tie ir šķietami cieši saistīti tiesību institūti un varētu pat šķist - kalpo vienam mērķi. Taču tā nebūt nav, to mērķi ir atšķirīgi, proti, mantojuma aizgādnības mērķis ir nodrošināt mantojuma masas kā juridiskas personas pārstāvību mantojuma masai, savukārt mantojuma apsardzības - aizsargāt mantinieku, legatāru un kreditoru intereses, ja pastāv izvazāšanas draudi. Bakalaura darba mērķis ir izpētīt mantojuma aizgādnības un apsardzības regulējumu normatīvajos tiesību aktos, konstatēt esošos problēmjautājumus un rast iespējamos risinājums Darba izstrādes gaitā tiek pētīti un analizēti normatīvie akti, tiesu nolēmumi, juridiskā literatūra.

The institutes for the guardianship and protection of the succession are regulated in one section of the Civil Law, the second section of Chapter Five (Article 657-666), so they are supposedly closely linked legal institutes and may even seem to serve one purpose, but they do not have different objectives, namely the protection of the heritage is aimed at ensuring that the heritage is protected. The purpose of protecting the interests of heirs, legatees and creditors, where there is a threat of foreclosure, is the representation of the masses as a legal person. The aim of the work of the bachelor is to investigate the regulation of the guardianship and guarding of the succession in regulatory enactments, to identify existing issues and to find possible solutions in the course of the development of work, regulatory enactments, court rulings are investigated and analysed.
