Tiesībsargs kā viens no subjektiem, kurš var iesniegt pieteikumu Satversmes tiesā

Abstract

Bakalaura darba mērķis ir izpētīt tiesībsarga tiesības iesniegt pieteikumu Satversmes tiesā. Lai sasniegtu šo mērķi, autore pēta tās Satversmes tiesas kompetencē esošās lietu kategorijas, par kurām tiesībsargam ir tiesības iesniegt pieteikumu Satversmes tiesā, prasības šī pieteikuma iesniegšanai, kā arī Satversmes tiesas nolēmumus, kas pieņemti saistībā ar tiesībsarga iesniegtajiem pieteikumiem. Darbā autore galvenokārt aplūko to, kā tiesībsarga institūts ir izveidojies Latvijā un to, kā tiesībsarga tiesības iesniegt pieteikumu Satversmes tiesā pakāpeniski mainījušās. Autore analizē Satversmes tiesā skatītās lietas, kas ierosinātas pēc tiesībsarga pieteikuma, un to, kāds ir bijis devums Latvijas tiesību attīstībā, pateicoties šīm izskatītajām lietām. Darbā autore secina, ka tiesībsarga tiesības vērsties Satversmes tiesā ir galējais līdzeklis tam, lai novērstu trūkumus tiesību aktos. Tiesībsargs vispirms preventīvi vēršas pie atbildīgām institūcijām, lai novērstu tiesību strīdu. Tiesībsargs ir vērsies Satversmes tiesā tādu cilvēku pamattiesību aizsardzībai, kas saistīti ar cilvēka cieņu, tiesisko vienlīdzību, privātās dzīves neaizskaramību, biedrošanās brīvību, tiesībām uz taisnīgu tiesu, tiesībām uz veselību, tiesībām uz īpašumu, kā arī tiesībām dzīvot labvēlīgā vidē. Vairumā šo lietu, kas ierosinātas pēc tiesībsarga pieteikuma, Satversmes tiesa atzīst pieteikumu par pamatotu un apstrīdēto tiesību normu par neatbilstošu Satversmē garantētajām pamattiesībām.

The goal of bachelor's thesis is to study the rights of the ombudsman to submit an application to the Constitutional Court. In order to achieve this goal, the author studies the categories of cases within the competence of the Constitutional Court, regarding which the Ombudsman has the right to submit an application to the Constitutional Court, claims for the submission of this application, as well as decisions adopted by the Constitutional Court in relation to applications submitted by the Ombudsman. The author of the thesis mainly focuses on how the Ombudsman's institute has been formed in Latvia and how the Ombudsman's right to submit an application to the Constitutional Court has progressively changed. The author analyses the cases examined in the Constitutional Court, which have been initiated upon the Ombudsman's application, and what has been the contribution to the development of the rights of Latvia thanks to these examined cases. In her work, the author concludes that the right of the Ombudsman to apply to the Constitutional Court is a measure of last resort to eliminate flaws in legislative acts. The Ombudsman preventively applies to the responsible institutions to prevent a legal dispute. The Ombudsman has applied to the Constitutional Court for the protection of the fundamental rights of people related to human dignity, legal equality, inviolability of privacy, freedom of association, right to fair trial, right to health, right to property, as well as the right to live in a favourable environment. In the majority of these cases, which have been initiated on the basis of an application of the Ombudsman, the Constitutional Court recognizes the application as well-grounded and the appealed norm of law as non-compliant with the fundamental rights guaranteed in the Constitution.
