Izmeklētāja rīcība kriminālprocesā ar trešai personai piederošu transporta līdzekli

Abstract

Bakalaura darbs rakstīts kriminālprocesā par tēmu “Izmeklētāja rīcība kriminālprocesā ar trešai personai piederošu transporta līdzekli”. Šī tēma ir aktuāla, jo palielinoties transportlīdzekļu skaitam palielinās arī kriminālprocesu skaits, kuros tie ir iesaistīti, kā rezultātā izmeklētājam ir jālemj par rīcību ar transportlīdzekli. Darbā aplūkota transportlīdzekļa definīcija dažādos normatīvajos aktos, kādās procesuālajās darbībās transportlīdzekļi var būt iesaistīti, kā var ierobežot trešās personas, kā īpašnieka, tiesības uz īpašumu. Darbs izstrādāts balstoties uz Latvijas Republikas normatīvajiem aktiem un tiesu praksi. Darba izstrādē tika izmantota ne tikai Latvijas Republikas tiesu prakse, bet arī starptautiskā tiesu prakse. Darbā ir izteikti priekšlikumi par prakses pilnveidošanu saistībā ar trešo personu, kura ir aizskartās mantas īpašnieks. Atslēgvārdi – transportlīdzekļi, mantas arests, izmeklēšanas darbības, glabāšana, procesuālie izdevumi.

The bachelor thesis is written in the criminal proceedings about the topic “Actions of investigator in criminal proceedings with a vehicle that belongs to a third person”. The significancy of this topic is rising because as the number of vehicles are increasing, so does the number of criminal proceedings in which vehicles are involved, which leads to investigator having to decide what to do with the vehicle. The bachelor thesis focuses on the definition of vehicle in various laws and regulations, in what criminal proceeding actions vehicles may be involved in, and how the property rights of the third party can be restricted. The bachelor thesis is based on the laws, regulations and law cases of the Republic of Latvia. Not only the case laws of the Republic of Latvia, but also internation case laws were used in the making of the thesis. The bachelor thesis makes suggestions for law and regulation improvements of a third party who is the owner of the tampered property.
