Pārrobežu laulības šķiršanas tiesiskie aspekti

Abstract

Izstrādātais maģistra darbs „Pārrobežu laulības šķiršanas tiesiskie aspekti” ir vērsts uz pārrobežu laulības šķiršanu lietu analīzi un šādu kategoriju lietās pastāvošo problēmjautājumu izpēti, ar mērķi dot priekšlikumus normatīvo aktu pilnveidei. Maģistra darba izstrāde balstīta uz dažādu normatīvo aktu, tiesu prakses un juridiskās literatūras izpēti. Tāpat darbā plaši izmantota internetā pieejamā informācija – nozares speciālistu publicētie viedokļi un raksti, statistikas dati. Darba ietvaros tiks analizēta gan ārvalstu, gan nacionālā – Latvijas, tiesu prakse. Iegūtie statistikas dati ir izmantoti un ir svarīgi darba tēmas aktualitātes pamatošanai. Maģistra darbā tiks apskatīta tiesu prakse, jo tā ietvaros tiek interpretētas tiesību normas, tādējādi izskaidrojot normatīvos aktus un sniedzot komplicētas atbildes uz konkrētā strīdus situācijām. Darbā apkopojot un analizējot pieejamo informāciju, darba autore spēja izcelt analizētajās lietu kategorijās pastāvošās problēmas, kā arī sniegt priekšlikumus normatīvo aktu pilnveidei, kas darba autores ieskatā atvieglos šādos procesos iesaistīto personu tiesību īstenošanas iespējas, novēršot pastāvošās neskaidrības. Maģistra darbs ir rakstīts latviešu valodā un sastāv no 3 nodaļām, secinājumiem un priekšlikumiem, anotācijām latviešu un angļu valodās, izmantotās literatūras saraksta, un ir uz 65 lapaspusēm.

The developed Master’s Thesis Legal Aspects of Cross-Border Dissolution of Marriage is aimed at analysing cases of cross-border dissolution of marriage and researching the problem issues in the cases of this category with the purpose of providing proposals for improvement of laws and regulations. The Master’s Thesis has been developed based on research of various laws and regulations, case law and legal literature. The Thesis has also extensively used the information available on the internet: opinions and articles published by professionals of the sector, statistical data. The Thesis has analysed both foreign and national, Latvian, court practices. The obtained statistical data have been used and are important to justify topicality of the subject of the Thesis. The Master’s Thesis reviews the court practices because they interpret legal provisions, thus explaining laws and regulations and providing complicated answers to situations in the particular dispute. Upon summarising and analysing the available information in the Thesis, the author has managed to emphasize problems existing in the analysed categories of cases as well as to provide proposals for improvement of laws and regulations, which, according to the author, will facilitate implementation of rights of persons involved in such cases by eliminating the existing uncertainties. The Master’s Thesis is compiled in Latvian and consists of 3 chapters, the conclusions and proposals, the annotations in Latvian and English, the list of used literature, and it composes 65 pages.
