Personiskie pierādīšanas līdzekļi civilprocesā.

Abstract

Maģistra darbā, kurš sastāv no piecām nodaļām, tiks skatītas Civilprocesa likuma daļas, kas saistītas ar personiskajiem pierādīšanas līdzekļiem, sniedzot vispārīgu pierādījumu un pierādīšanas jēdzienu skaidrojumu, analizējot to lomu lietas izskatīšanā un aplūkojot personisko pierādīšanas līdzekļu jēdzienu un būtību. Autore analizēs personiskos pierādīšanas līdzekļus apzinot pastāvošos problēmjautājumus un izvērtējot iespējamās alternatīvas. Rezultātā autore izdara secinājumus un ierosina priekšlikumus Civilprocesa likuma normu pilnveidošanai un grozīšanai attiecībā uz pierādījumu iesniegšanas termiņu, vērtē nepieciešamību pieļaut rakstveida liecinieku liecības tiesā, zvēresta institūta ieviešanu, rosina veikt grozījumus Civilprocesa likuma 73.1 panta pirmajā daļā, Civilprocesa likuma 104.pantā un citos pantos.

The Master's thesis, consisting of five chapters, will view parts of the Civil Procedure Law that relate to personal means of proof, providing an explanation of the general concept of evidence and proving, analyzing their role in the hearing and viewing the concept and essence of personal evidence. The author will analyze the personal means of proof by identifying existing issues and evaluating possible alternatives. In the result, the author draws conclusions and gives proposals for the improvement and amendment of the provisions of the Civil Procedure Law regarding the term of submission of evidence; assesses the necessity to allow written witness testimony; introduction of an oath institution; suggests the amendments to the first part of Article 73.1 of the Civil Procedure Law, Article 104 and other articles of the Civil Procedure Law.
