Maģistra darbā “Kriminālatbildība par noziedzīgi iegūtu līdzekļu legalizēšanu”, tiek aplūkotas noziedzīgi iegūtu līdzekļu legalizēšanas novēršanas normatīvā regulējuma aktuālās problēmas. Darbs satur noziedzīgi iegūtu līdzekļu legalizācijas regulējuma analīzi, saistītās tiesu prakses, tiesību literatūras un tiesību pētnieku izdevumos pausto viedokļu izpēti. Darba gaitā autors apskata pastāvošās problēmas, kas saistītas ar Noziedzīgi iegūtu līdzekļu legalizācijas un terorisma finansēšanas novēršanas likuma 5.panta un Krimināllikuma 195.panta plašo tvērumu, kas rada kolīziju ar citām Krimināllikuma normām un apgrūtina noziedzīga nodarījuma kvalifikāciju. Autora secinājumi un ierosinājumi ir vērsti uz Krimināllikuma pilnveidošanu, kā arī pārlieku izvērstā noziedzīgi iegūtu līdzekļu legalizācijas novēršas regulējuma tvēruma robežu iezīmēšanu un normu konkurences risināšanu. Masters’ Thesis “Criminal Liability for Money Laundering” discusses the current challenges of the regulatory framework for the Prevention of Money Laundering. The research paper consists of analysis of the regulatory framework for money laundering and a study of the views expressed in the related judicial practice, legal literature and law researchers’ publications. In the course of the work, the author shall examine the existing problems related to Section 5 of the Law on the Prevention of Money Laundering and Terrorism Financing and Section 195 of the Criminal law which create conflict with other provisions of the Criminal Law and hinder the qualification of a criminal offence. The author’s conclusions and suggestions focus on improving the Criminal Law, as well as on highlighting the scope of the regulation and addressing the competition between the rules of law.
