Abstract

Darba tēma: Mantiska rakstura kritēriji Krimināllikuma sevišķās daļas normās. Darbā pētīts: kā mantiska rakstura kritēriji atspoguļojas Krimināllikuma normās; ko tie raksturo. Darba mērķis: izpētīt mantiska rakstura kritēriju atspoguļojumu Krimināllikumā, aptverot vispārīgā raksturojuma, vēsturiskās attīstības, to jēdzienu un būtības izpēti, noskaidrojot, kā nosakāma priekšmeta vērtība un zaudējumu apmērs, papildus iepazīstoties ar mantiska rakstura kritēriju atspoguļojumu ārvālstu normatīvajā regulējumā, tādā veidā izanalizējot katru no mantiska rakstura kritērijiem. Darba uzdevumi: izpētīt pieejamo literatūru, iepazīties ar ārvalstu normatīvo regulējumu; analizēt katru mantiska rakstura kritēriju, salīdzināt tos; apkopot iegūto informāciju; izdarīt secinājumus. Iegūtie rezultāti: iegūts pārskats par katru no mantiska rakstura kritērijiem, to atspoguļojumu Krimināllikuma normās. Noskaidrots, ka citu valstu Kriminālkodeksu regulējumos apmērs ir izteikts konkrētā naudas summā, taču Latvijā apmēru raksturojums veiksmīgi ietverts likumā “Par Krimināllikuma spēkā stāšanās un piemērošanas kārtību” un izteikts minimālajās mēnešalgās. Šobrīd tiek lemts par jauna vērtējuma jēdziena kā maznozīmīgs noziedzīgs nodarījums ieviešanu krimināltiesību nozarē. Atslēgas vārdi: neliels apmērs, ievērojams apmērs, liels apmērs, būtisks kaitējums, smagas sekas.

The theme of the Master's Thesis: Criteria of material nature in the special part of the Criminal Law. The analysis of: how the criteria of material nature are reflected in the norms of the Criminal Law; what they describe. The aim of the Master's Thesis: To explore the reflection of the material criteria in the Criminal Law, covering the study of general characteristics, historical development, their concept and essence research, to find out how to determine the value of the object and the extent of the loss, moreover, to look at the reflection of the material criteria in foreign criminal codes, in order to analye every criterion of material nature. The objectives of the Master's Thesis: To explore available literature, to explore the foreign normative regulation; to analyze every material criterion, to compare them; to collect obtained information; draw conclusions. The results of the Master's Thesis: The summary of every of the criteria of material nature and their reflection in the norms of the Criminal Law. It was found out that in other countries the amount in the Criminal Code is expressed in a specific amount of money, but in Latvia characterization of the amount is successfully included in the special law and expressed in minimum monthly wages. It is now suggested to introduce a new concept – a minor offense. Keywords: small amount, significant amount, large amount, substantial damage, serious consequences.
