Kopfinansējums ir viens no relatīvi jaunajiem alternatīvajiem finansējuma piesaistes veidiem, kas vienlaicīgi ļauj personām, kas vēlas īstenot kādu biznesa ideju, uzsākt saimniecisko darbību vai īstenot kādu projektu, viegli piesaistīt lielu daudzumu investoru, savukārt investoriem ir iespēja ieguldīt savus personīgos līdzekļus, tādā veidā palielinot savu kapitālu vai saņemto pretī kādu labumu (piemēram, produktu vai pakalpojumu). Savstarpējo aizdevumu modelis, kas ir viens no kopfinansējuma veidiem, dod iespēju projektu izstrādātājiem saņemt aizdevumu no citām fiziskām vai juridiskām personām, izmantojot savstarpējo aizdevumu platformu, un ļauj investoriem aktīvi izvēlēties kā to līdzekļi tiek ieguldīti, tai skaitā, izvēlēties personas, kurām izsniegt aizdevumu. Darba ietvaros autore aplūko kopfinansējumu kā mūsdienīgu risinājumu nepieciešamībai pēc finansējuma, tā veidus, koncentrējoties tieši uz savstarpējiem aizdevumiem, izpratnes maiņu par to, uz kādiem pakalpojumiem var attiecināt terminu “savstarpējie aizdevumi”, kā arī iezīmē būtiskākos riskus visām iesaistītajām pusēm, kontekstā ar šobrīd esošo regulējumu un plānoto regulējumu Latvijas un Eiropas Savienības līmenī. Darbā autore nonāk pie secinājuma, ka valsts iestādes, tiesu vara un likumdevējs, vismaz uz darba sagatavošanas brīdi, ir izvēlējušies konservatīvu pieeju tam, kādus pakalpojumus var uzskatīt par kopfinansējuma pakalpojumiem. Neskatoties uz to, kopfinansējuma, tai skaitā, savstarpējo aizdevumu, pakalpojumu sniegšanas regulējuma izstrāde ir vērtējama pozitīvi. Crowdfunding is one of the relatively new alternative ways of acquiring financing, which simultaneously allows persons, who wish to realize a business ideas, set up an economic activity or carry out a project, to easily acquire a large amount of investors, in turn the investors have an opportunity to invest their personal funds, thus increasing their capital or receiving some benefit (such as a product or service). The peer-to-peer lending model, which is one of crowdfunding types, grants an opportunity for project initiators to receive loans from other physical or legal persons, using a peer-to-peer lending platform, and allows the investors to actively choose how their funds are invested, including, choose the persons to whom they issue a loan. In the paper the author looks at crowdfunding as a modern solution to the necessity to acquire financing, its types, concentrating particularly on peer-to-peer lending, the shift in understanding what services can be deemed to be “peer-to-peer lending”, as well as outlines the most significant risks for all parties involved, in the context of current regulation and planned regulation at the Latvian and European Union level. In the paper the author comes to a conclusion that the public authorities, judiciary and legislator, at least at the time of preparation of this work, have chosen a conservative approach to what services can be considered as crowdfunding services. Nevertheless, the development of regulation for crowdfunding, including peer to peer lending, services is a positive occurrence.
