Piespiedu nomas institūts.

Abstract

Maģistra darbā “Piespiedu nomas institūts” tiek izskatīta jau vairāk nekā 25 gadus aktuāla problēma piespiedu noma, kas ir radusies zemes reformas un nacionalizēto īpašumu denacionalizācijas rezultātā, pastāvot dalītam īpašumam. Darbā tiek pētīts piespiedu nomas jēdziens un būtība, no piespiedu nomas izrietošās tiesiskās attiecības, ietverot, zemes un būves īpašnieka pienākumus un tiesības, tajā skaitā pienākumu slēgt līgumu. Darbā ir izskatīts arī jautājums par zemes īpašnieku prasījumu noilgumu piespiedu nomas ietvaros, gadījumā, ja zemes īpašnieks ir komersants, kā arī piespiedu nomas un tā regulējuma attīstība laika gaitā. Darba rezultātā ir apkopota tiesu prakse, veiktie pētījumi un juristu viedokļi par piespiedu nomas aktuālajiem jautājumiem Latvijā.

Master thesis “Institute of forced lease” looks thought and actual problem of over than 25 years, that has arisen as a result of the land reform and the denationalization of nationalized property. The work looks into the concept and essence of forced lease, the legal relations of forced lease, including the obligations and rights of the land and building owner, also obligation to conclude an agreement. Within the framework of the work, also is considered the issue of land owners claim limitation in forced lease, if the land owner is a merchant, also the development of forced lease and its regulation over time. During the research, there is compiled court practice and legal opinions about issues of forced lease in Latvia.
