Prezumpciju piemērošana Latvijas civiltiesībās un civilprocesā nav sveša, tomēr darba gaitā autors ir konstatējis, ka Latvijas tiesu praksē nav vienota viedokļa par prezumpciju piemērošanas metodēm un prezumpciju ietekmi uz pierādīšanas pienākumu. Darba gaitā autors, pētot citu valstu likumus un tiesību zinātnieku atziņas, salīdzinājumā ar Latvijas civilprocesuālo regulējumu piedāvā vispārēju prezumpciju definīciju un iedalījumu. Atkarībā no prezumpciju iedalījuma darbā tiek noteikta katras prezumpcijas veida ietekme uz pierādīšanas pienākumu, kā arī prezumpciju pierādīšanas un apstrīdēšanas metodes. Izpildot darba mērķi, proti, noskaidrojot, kāda ir prezumpciju loma pierādīšanas procesā, un noskaidrojot prezumpciju ietekmi uz pierādīšanas pienākumu, kā arī identificējot prezumpciju pierādīšanas un apstrīdēšanas īpatnības salīdzinājumā ar citu faktu pierādīšanu civilprocesā, tiek piedāvāti attiecīgi grozījumu Civilprocesa likumā. The application of presumptions in Latvian civil law and civil proceedings is not unknown, but over the course of this research paper the author has found that there is no common view in the practice of the courts of Latvia regarding methods of application of presumptions and the impact of presumptions on the burden of proof. In addition to that, over the course of its work after studying the laws and the views of law specialists of other countries’, the author offers a general definition and categorization of presumptions in comparison with the Latvian civil procedural regulation. Depending on the categorization of presumptions, this research paper shall determine the effects of each type of presumption on the burden of proof, as well as the methods of proving and rebutting a presumption. In fulfilling the objectives of the research paper, that is, to ascertain the role of the presumption in the burden of proof, to ascertain the impact of the presumption on the burden of proof, to identify the peculiarities of the burden of proof and challenge in comparison with the proving of other facts in civil proceedings, the amendments to the Civil Procedure Law are proposed accordingly.
