Autortiesību regulējums būvprojekta ietvaros.

Abstract

Bakalaura darbā ir pētīts, vai Latvijas Republikas autortiesību tiesiskais regulējums atbilst mūsdienu praksei būvniecības nozarē, izstrādājot būvprojektu. Bakalaura darbā apstiprinās Autores izvirzītā tēze, ka pastāv kolīzijas starp būvniecības un autortiesību institūtu, un autortiesības ir nepilnīgi piemērojamas būvniecības tiesībās, tādējādi būvprojekta autors netiek pilnībā nodrošināts ar Autortiesību likumā noteiktajām autora tiesību garantijām. Autore vērš uzmanību, ka iepriekš minētās kolīzijas ietekmē arī sabiedrības tiesību izpratni un piemērošanu praksē. Bakalaura darbā ir sniegti ierosinājumi analizēto nepilnību novēršanai, tostarp tiesību avotu grozījumiem.

The bachelor's thesis examines, whether the legal regulation of the copyright in the Republic of Latvia corresponds to the current practice in the construction industry, when drawing up a building design. The bachelor's thesis confirms the Author's argument, that there are collisions between the institute of the construction and the copyright, and the copyright is incompletely applicable to the construction law, thus the person, who draws up the building design, is not fully provided with the copyright guarantees specified in the Copyright Law. The Author points out, that the above-mentioned collisions also affect the public understanding and application of law in practice. The bachelor's thesis provides suggestions for the elimination of the analysed shortcomings, including amendments to the sources of law.
