Dzīvesbiedru likuma analīze un atbilstība Latvijas Republikas Satversmei

Sabiedrības sociālu pārmaiņu rezultātā, arvien biežāk pāri dzīvo nevis laulībā, bet ārpus laulības kopdzīvē. Šīs pārmaiņas novērojamas statistikā par bērnu dzimšanu ārpus laulības, kas pēdējo trīsdesmit gadu laikā ir dubultojusies. Lielākā daļa iebildumu par ārpus laulības kopdzīves regulējumu izriet, ka piedāvātajās iniciatīvās tiek atļauta attiecību reģistrēšana viendzimuma pāriem, tajā saskatot neatbilstību Satversmes 110. pantam. Darba mērķis ir noskaidrot Dzīvesbiedru likumprojekta tvērumu un atbilstību Satversmei, tāpēc autors analizēja Dzīvesbiedru likuma mērķi, vienlaikus noskaidrojot Satversmes 110. pantā ietvertā jēdziena “ģimene” saturu un valsts pienākumu ģimeņu aizsardzībā. Darba gaitā autors secinājis, ka Dzīvesbiedru likuma mērķis nesatur Satversmei neatbilstošu likumdevēja rīcību, bet subjektu dzimumu neitralitāte, kas ļauj viendzimuma partneriem noslēgt dzīvesbiedru līgumu vai konstatēt faktisko dzīvesbiedru savienību, nav pretrunā ar Satversmes 110. pantā ietvertā jēdziena “ģimene” saturu. As a result of social change in society, couples are increasingly living together outside of marriage. These changes can be seen in the statistics on out-of-wedlock births, which have doubled in the last thirty years. Most of the objections regarding the regulation of extramarital cohabitation follow that the proposed initiatives allow the registration of relationships for same-sex couples, seeing it as inconsistent with Article 110 of the Constitution. The aim of the work is to clarify the scope and compliance of the draft Law on Life Spouses with the Constitution, therefore the author explains the content of the term “family” included in Article 110 of the Constitution and the duty of the state to protect various types of families. In the course of the work the author has concluded that the purpose of the Life Spouses Law does not contain actions by the legislator which are inconsistent with the Constitution, furthermore, gender neutrality of the subjects, which allows same-sex partners to enter into a life spouses agreement or establish cohabitation, does not contradict with the Constitution.
