Valsts padomes institūta izveidošana Latvijā

Abstract

Bakalaura darba mērķis ir izvērtēt Valsts padomes izveides nepieciešamību un iespēju Latvijā. Lai sasniegtu bakalaura darba mērķi, ir veikta padziļināta izpēte par tām Eiropas valstīm, kurās šāds institūts jau ir izveidots, ietverot juridiskās literatūras, kā ārvalstu tā Latvijas normatīvā regulējuma un tiesas prakses izpēti. Darbā ir izpētīti deviņu Eiropas valstu padomju institūti, analizēta Latvijā esošā situācija likumdošanas jomā un esošie atbalsta mehānismi likumdevējam, lai varētu pamatot Valsts padomes institūta izveides nepieciešamību un modelēt tās iespējamo tiesisko statusu, funkcijas, lēmumu tiesisko spēku, organizāciju un sastāvu. Darba ietvaros ir secināts, ka Valsts padomes izveide Latvijā ir nepieciešama un spētu uzlabot likumdošanas kvalitāti Latvijā, agrīni novērst kļūdainu lēmumu pieņemšanu, kā arī sekmēt sabiedrības uzticēšanos likumdevējam. The aim of the bachelor's thesis is to evaluate the necessity and possibility of setting up the Council of State in Latvia. To achieve the aim of this bachelor’s thesis, an in-depth study has been done about European countries where such an institute has already been established, this has been done by analysing legal literature, researches, studying a regulatory framework of foreign states and Latvia, and a study of the case-law. Work includes analysis of nine European countries in which has been established the State of Council, analysis of the legislative situation in Latvia and existing support mechanisms for the legislator, to justify the necessity for establish Council of State and to model its possible legal status, functions, legal force of its decisions, organisation and composition. The work concludes that the establishment of the Council of State in Latvia is necessary and would be able to improve the quality of legislation in Latvia and promote public confidence in the legislator.
