Pētījumā “Patenta pieteikuma izvērtēšana atbilstoši Latvijas, Lietuvas un Igaunijas likumiem” autore analizē un salīdzina patenta pieteikuma izvērtēšanas regulējumus Baltijas valstīs. Autore konstatē būtisku problēmu t.i. Latvijas Republikas Patentu likums nosaka, ka veicot patenta pieteikuma izvērtēšanu netiek veikta izgudrojuma pilnīga patenspējas ekspertīze, proti, netiek vērtēts vai izgudrojumam piemīt novitāte un izgudrojuma līmenis, kā arī nav paredzēta obligāta patentmeklējuma veikšana, tas savukārt rada virkni nelabvēlīgu seku un palielina patentu pārkāpumu iespējamību. Autore secina, ka nepieciešams veikt salīdzinājumu starp Baltijas valstīm un pilnveidot esošo tiesību normas noregulējumu jautājumā par patenta pietikuma izvērtēšanu. Darba ietvaros autore sniedz konkrētus Latvija Republikas Patenta likuma satura ierosinājumus. Pētījums sadalīts piecās nodaļās, kuru ietvaros veikta spēkā esošo normu analīze un salīdzināšana. In the study “Patent application evaluation according to Latvian, Lithuanian and Estonian law”, author analyses and compares assessment frameworks for the patent applica- tion in the Baltic States. The author identifies several problems, i.e. The Patent Law of the Re- public of Latvia determines that in assessment of a patent application does not carry out a complete expert-examination of the patentability of the invention, i.e. is not performed, namely the novelty and the inventive step of invention is not evaluated, does it provide for the performance of a compulsory search, which in turn causes a number of adverse consequences and increases the likelihood of patent infringements. The author concludes that it is necessary to make a comparison between the Baltic States and to improve the settlement of the existing legal norm in the issue regarding the assessment of the patent application. Within the framework of the work, the author shall provide specific proposals for the content of the Republic of Latvia Patent Law. The study is divided into five chapters for analysis and comparison of existing norms.
