Lai kreditoriem radītais zaudējumu apmērs juridiskas vai fiziskas personas maksātnespējas pasludināšanas brīdī neturpinātu palielināties arī pēc maksātnespējas pasludināšanas, par parādnieka pārstāvēttiesīgo personu tiek iecelts maksātnespējas procesa administrators. Lai gan maksātnespējas procesa administrators ir juridiskās nozares profesionālis, praksē rodas situācijas, kad maksātnespējas procesa administratora rīcības rezultātā tiek nodarīts kaitējums kreditoriem vai trešajām personām. Tomēr tiesību aktos nav expresis verbis noteikts, ka maksātnespējas procesa administratora civiltiesiskā atbildība būtu pielīdzināma komercsabiedrības valdes locekļa civiltiesiskai atbildībai. Autore darbā analizē minēto lēmējinstitūtu atbildības apmēru un secina, ka praksē komercsabiedrības valdes loceklim tiek noteikts augstāks atbildības standarts. In order to ensure that the amount of losses caused to creditors at the time of the declaration of insolvency of a legal or natural person does not continue to increase even after the declaration of insolvency, an insolvency administrator is appointed as the debtor's representative. Although the insolvency administrator is a legal professional, in practice there are situations where the actions of the insolvency administrator result in damage to creditors or third parties. However, the law does not stipulate expresis verbis that the civil liability of an insolvency administrator should be comparable to the civil liability of a member of the board of a commercial company. The author analyzes the extent of the responsibility of the mentioned decision-making institutes and concludes that in practice a higher standard of responsibility is set for a member of the board of a commercial company.
