Abstract

The aim of the thesis is to research how the real division of the of the entirety of property of an estate takes place in accordance with the law, when and which co-heirs are entitled to demand the division of an estate and their mutual relations, as well as the determination of the property to be divided. In order to create a more comprehensible view of the real division of the the entirety of property of an estate, the author will also analyse how certain matters are regulated abroad. The aim of the thesis will be achieved by reviewing and analysing regulation of other countries, case law, legal acts and sources of law, findings in the legal writings, as well as analysing the mutual relations of co-heirs, from which all problematic issues arise.
