Problemātika saistībā ar valsts amatpersonu ievēlēšanu, iecelšanu, apstiprināšanu un atbrīvošanu no amata

Abstract

Bakalaura darba tēma ir problemātika saistībā ar valsts amatpersonu ievēlēšanu, iecelšanu, apstiprināšanu un atbrīvošanu no amata. Darba būtība ir analizēt un izprast galvenās problēmas, kas ir saistītas ar valsts amatpersonu amatu ieņemšanu un atbrīvošanu no tā, izvērtēt tiesiskā regulējuma efektivitāti, izdarīt secinājumus un sniegt priekšlikumus problemātikas novēršanai. Darbā tiek aplūkots Latvijas normatīvo aktu tiesiskais regulējums attiecībā uz tādu valsts amatpersonu kā tiesnešu, ģenerālprokurora, tiesībsarga, valsts kontroliera un citu amatpersonu pilnvaru iegūšanu un izbeigšanos. Šādu amatpersonu iecelšanai amatā ir jābūt balstītai uz neitrālu, objektīvu un uz profesionālajiem kritērijiem orientētu lēmumu, nevis uz politiskiem apsvērumiem balstītu lēmumu. Izstrādājot darbu, tika pētīta valsts prezidenta loma amatpersonu iecelšanā, kā arī apskatīta amatpersonu iecelšanas kārtība ārvalstīs.

The theme of the bachelor's thesis is problems related to the election, appointment, approval and dismissal of the public officials. The aim of the work is to analyze and understand the main problems related to the appointment and dismissal of public officials, also to evaluate the effectiveness of the legal framework, to draw conclusions and provide proposals for the elimination of the problem. Also the role of the President in the appointment of officials was studied, as well as the procedure for the appointment of officials in other countries. The paper deals with the legal regulation of Latvian regulatory system regarding the appointment and dismissal of such public officials as judges, the Prosecutor General, the Ombudsman, the State Comptroller and others. The appointment of such officials must be a neutral, objective decision based on professional criteria and not a decision based on political considerations.
