Kultūras pieminekļu tiesiskā regulējuma nepilnības Latvijā

Abstract

Darba mērķis ir kultūras pieminekļu (ēku) problemātikas izvērtēšana Latvijā, kas ietver galvenokārt kultūras pieminekļu aizsardzību un īpašnieku tiesību aprobežojumu izpēti. Darba uzdevumi ir vērsti uz normatīvo aktu, tiesas spriedumu salīdzināšanu un analīzi, un priekšlikumu ierosināšanu. Darbā tiek pētīta Nacionālā kultūras mantojuma darbība un īpašnieku tiesības un pienākumi. Kultūras pieminekļu aizsardzība joma Latvijā attīstās, bet tas notiek ļoti lēni. Normatīvo aktu tiesību normas nav pilnvērtīgas, starp normatīvajiem aktiem novērojamas pretrunas. Valsts atbalsts kultūras pieminekļu aizsardzības jomā ir nepietiekošs, it sevišķi finansiālais atbalsts. Īpašnieki bieži neievēro kultūras pieminekļu aizsardzības noteikumus, kā rezultātā tiek zaudēta objekta kultūrvēsturiskā vērtība. Pārvaldes darbība nav vienoti organizēta, kultūras pieminekļu saraksts nav atjaunināts un bieži satur neprecīzu informāciju, tāda situācija novērojama arī zemesgrāmatā veiktajos ierakstos.

The aim of the thesis is to evaluate the problems of cultural monuments (buildings) in Latvia, which includes mainly the protection of cultural monuments and the study of restrictions on ther it sofowners. The tasks of the thesis are focused on the comparison and analysis of regulatory enactments, court judgments, and proposing proposals. The thesis examine the operation of the National Cultural Heritage and the rights and obligations of the owners. The field of protection of cultural monuments in Latvia is developing, but it is happening very slowly. The legal norms of regulatory enactments are not full-fledged, there are contradictions between regulatory enactments. States upport for the protection of cultural monuments is insufficient, especially financial support. Owners often do not follow the rules for the protection of cultural monuments, as a result of which the cultural and historical value of the object is lost. The activities of the Board are not uniformly organized, the list of cultural monuments is not updated and often contains in accurate information, such a situation canals obeobserves din the entries made in the Land Register.
