dc.description.abstract | Bakalaura darba mērķis ir analizēt Latvijas tiesisko regulējumu un tiesu praksi, lai izdarītu secinājumus par Latvijas tiesiskā regulējuma atbilstību mūsdienu Eiropas Savienības tiesībās formulētajām atziņām grūtnieču tiesiskās aizsardzības kontekstā. Bakalaura darbā analizēti jautājumi, kas aptver likumā paredzētus ierobežojumus darba devējam, dodot īpašas speciālās garantijas grūtniecēm un sievietēm pēcdzemdību periodā. Apskatīts, no kura brīža darbiniecei ir tiesības uz likumā paredzētajām speciālajām garantijām un kad šādu tiesību nav. Pētīts grūtnieces īpašais stāvoklis attiecībā uz pārējiem darbiniekiem, kas, piemēram, dod tiesības grūtniecei ikgadējo apmaksāto atvaļinājumu lūgt neatkarīgi no laika, cik ilgi tā ir nodarbināta pie attiecīgā darba devēja, kamēr pārējie darbinieki ir tiesīgi to lūgt tikai pēc sešu mēnešu nepārtrauktas nodarbinātības. Apskatīts, ka jautājumi, kas ir tieši vai netieši diskriminējoši, kā, piemēram, jautājumi par sievietes grūtniecību, ģimenes un laulības stāvokli, darba intervijā nav pieļaujami. Analizēts tas, vai ir nepieciešama rakstveida piekrišana, lai nodarbinātu grūtnieci virsstundu darbā, nakts darbā, nedēļas atpūtas laikā, kā arī sūtītu darbinieci komandējumā vai darba braucienā. | |
dc.description.abstract | The aim of the bachelor's thesis is to analyze the Latvian legal framework and court practice in order to draw conclusions about Latvian legislation compliance with in modern European Union law formulated opinions for the context of the legal protection of pregnant women. The bachelor's thesis analyzes issues that cover the restrictions provided by law for the employer, giving special guarantees for pregnant women and women during the period of following childbirth. In thesis is discussed about moment from which the employee is entitled to the special guarantees provided by law and when there is no such right. In the thesis is discussed about the specific situation of a pregnant woman regard to other employees, which, for example, entitles a pregnant woman to request paid annual leave regardless of the length of time she has been employed, while other employees are only entitled to request it after six months of continuous employment. It is discussed about questions that are not allowed in a job interview, who are directly or indirectly discriminatory, such as questions about a woman's pregnancy, family and family status. In thesis is discussed about whether is required to need written agreement for pregnant woman employment in overtime work, night work, weekly rest, as well as to send an employee on a business trip or business trip. | |
