Brīvības atņemšana ir bargākais soda veids, kāds paredzēts Krimināllikumā. Tomēr ir iespēja noteikto brīvības atņemšanas termiņu ne vienmēr izciest līdz galam, jo Latvijas regulējums paredz nosacītu pirmstermiņa atbrīvošanu. Krimināllikumā tiek noteikti vairāki nosacījumi, kuru precīza ievērošana nodrošina to, ka personai ir tiesības pretendēt uz nosacītu pirmstermiņa atbrīvošanu. Bakalaura darbs atspoguļo to, ka praksē nosacīti atbrīvotas personas nesasniedz soda mērķi un atkārtoti izdara noziedzīgus nodarījumus. Bakalaura darba mērķis ir izpētīt, kādos gadījumos tiesa atbrīvo personu nosacīti pirms termiņa, kā arī izpētīt nosacīti atbrīvotas personas uzraudzību un resocializācijas iespējas pēc ieslodzījuma, vienlaikus norādot uz praksē pastāvošo situāciju. Darba autore divu gadu garumā veica 400 ieslodzījumā uzturošos notiesāto anketēšanu un intervēšanu. Pētījuma gaitā tika apkopota informācija par notiesāto attieksmi pret nosacītas pirmstermiņa atbrīvošanas un resocializācijas institūtu. No pētījuma izriet, ka notiesāto videi raksturīgas vairākas problēmas, ar kurām tiek saistīts recidīvs. Darbā tiek sniegti ieteikumi situācijas uzlabošanai. Darba uzdevumi ir izpētīt nosacītas pirmstermiņa atbrīvošanas būtību un priekšrocības, kā arī akcentēt praksē nereti sastopamās problēmas. Papildus darbā tiek konspektīvi pārlūkots vēl dažu citu Eiropas valstu tiesiskais regulējums attiecībā uz nosacītu pirmstermiņa atbrīvošanu. Tas ļauj iegūt salīdzinošu priekšstatu par darbā apskatīto problemātiku un tās risināšanu citās valstīs. Deprivation of liberty is the most severe form of punishment provided for in the Criminal Law. However, as Latvian regulation provides for conditional release prior to completion of punishment, it is possible not to serve the period of deprivation of liberty in full. The Criminal Law sets out a number of conditions, the precise observance of which ensures that a person has the right to apply for conditional release prior to completion of punishment. The present Bachelor's Thesis reflects that in practice conditionally released persons do not serve the full punishment, thus not achieving its aim, and commit criminal offenses again. The aim of this Bachelor's Thesis is to study in which cases the court conditionally releases a person prior to the completion of punishment, as well as to examine the supervision and resocialization possibilities after imprisonment of a conditionally released person, at the same time pointing to the situation in practice. For two years the author of the given Thesis conducted questionnaire survey and interviews of 400 inmates. During the course of the research, information on the attitude of convicts towards the institute of conditional release prior to completion of punishment and resocialization was collected. The research shows that the environment surrounding convicts is characterized by several problems that the recidivism is connected to. This Thesis provides recommendations for improving the situation. The tasks of the given Thesis are to study the nature and advantages of conditional release prior to completion of punishment, as well as to highlight the problems that are often encountered in practice. In addition, the present Thesis concisely reviews the legal framework of some other European countries regarding conditional release prior to completion of punishment. This gives a comparative idea of the issues discussed in the Thesis and their solutions in other countries.
