Vienota tiesiska regulējuma normu nepieciešamība kapsētu uzturēšanas un apbedīšanas jomā

Abstract

Bakalaura darba tēma ir “Vienota tiesiska regulējuma normu nepieciešamība kapsētu uzturēšanas un apbedīšanas jomā”. Darba mērķis ir izpētīt, vai ir nepieciešams vienots regulējums apbedīšanas jomā, vai pietiek jau ar esošo normatīvo regulējumu. Darbā ir izpētītas un konstatētas galvenās Latvijas kapsētu problēmas un trūkumi. Apzināt esošā regulējuma problemātiku. Autore ir analizējusi literatūras avotus, normatīvos aktus, juridisko literatūru un tiesas spriedumos paustās tiesas atziņas. Darbs sastāv no četrām nodaļām un trīs apakšnodaļām. Pirmajā nodaļā aprakstīta normatīvajiem aktiem atbilstoša mirušo apbedīšana. Otrajā nodaļā analizēts normatīvais regulējums un pašvaldību rīcība jaunu kapa vietu piešķirot. Trešajā nodaļā aprakstīta Eiropas valstu pieredze. Ceturtajā nodaļā izvērtētas Satversmes tiesas sprieduma interpretācijas un to radītās sekas.

The bachelor's thesis is "The need for a unified legal regulation in the field of maintenance and burial of cemeteries". The aim of the work is to investigate whether a unified regulation in the field of burial is necessary, or whether the existing regulatory framework is sufficient. The main problems and shortcomings of Latvian cemeteries are studied and identified in the work. Identify the problems of the existing regulation. The author has analyzed literature sources, regulatory enactments, legal literature and court findings expressed in court judgments. The work consists of four chapters and three subsections. The first chapter describes the burial of the dead in accordance with regulatory enactments. The second chapter analyzes the regulatory framework and the actions of local governments in allocating a new grave site. The third chapter describes the experience of European countries. The fourth chapter evaluates the interpretations of the judgment of the Constitutional Court and the consequences thereof.
