Juridiskajā zinātnē nav vienotas izpratnes par ģenerālklauzulas konkretizācijas paņēmiena praeter legem piederību tiesību normu iztulkošanas vai arī tālākveidošanas juridiskajai metodei. Maģistra darbā “Ģenerālklauzulas izpratne un praeter legem metode” tiek pētīta paņēmiena būtība un pierādīts, ka paņēmiens ir tiesību tālākveidošana. Izšķirošais klasifikācijas arguments ir likumdevēja deleģējums tiesību piemērotājam veikt konkretizāciju. Paņēmiena metodoloģijas smaguma punkts ir trešās premisas formulēšana juridiskā siloģisma shēmā. Tādai intelektuālajai darbībai piemīt vērtējuma jeb aksioloģijas sprieduma elements, kas raksturīgs arī tiesību analoģijas metodei extra legem. Ņemot to vērā, tiek noskaidrots un pierādīts, ka konkretizācijas paņēmiens praeter legem nav tiesību analoģija. There is no common understanding in legal doctrine on whether the praeter legem method of concretizing general clauses belongs to the legal method of interpretation or further development of law. This master’s thesis “Meaning of Open Ended Terms and Praeter Legem Method” studies the nature of this method and concludes that it is a form of further development of law. The decisive argument for this classification is the delegation of concretizing from the legislator to the law applicator. The point of gravity of this method is the formulation of a third premise in the scheme of legal syllogism. Such intellectual activity possesses an element of value or axiology judgement, which is also characteristic of the extra legem method of analogy of law. In view of this, it is clarified and proved that the praeter legem method of concretization is not an analogy of law.
