Kriminālprocess Eiropas Prokuratūrā

Abstract

Bakalaura darba “Kriminālprocess Eiropas Prokuratūrā” mērķis ir izprast Eiropas Prokuratūras būtību, struktūru un kompetenci, sagaidāmo kriminālprocesa norisi tajā, kā arī iespējamās problēmsituācijas Eiropas Prokuratūras darbībā tieši Latvijā. Pētījuma gaitā pamatots, ka Eiropas Prokuratūras darbībā kā tādā ir paredzami daudzi izaicinājumi, bet tieši Latvijā dažādu juridisku sarežģījumu varētu būt vēl vairāk, jo likumprojekts “Grozījumi Kriminālprocesa likumā”, kurš izstrādāts, lai nodrošinātu normatīvā regulējuma atbilstību Padomes 2017. gada 12. oktobra regulai (ES) 2017/1939, ar ko īsteno ciešāku sadarbību Eiropas Prokuratūras (EPPO) izveidei, autoresprāt, nav sasniedzis mērķi Kriminālprocesa likumu pielāgot Eiropas Prokuratūras darbības vajadzībām Latvijā.

The aim of the bachelor’s thesis “Criminal proceedings in the European Public Prosecutor's Office” is to assess the idea, the structure and the competence of the European Public Prosecutor's Office and the way it will carry out criminal proceedings, as well as potential issues its activities could face in Latvia. The results of the research work show that many challenges can be foreseen regarding the functioning of the European Public Prosecutor's Office itself. More of these challenges can be expected in connection with its functioning in Latvia because the amendments to the Criminal Procedure Law aimed at implementation of Council Regulation (EU) 2017/1939 of 12 October 2017 implementing enhanced cooperation on the establishment of the European Public Prosecutor’s Office (‘the EPPO’) fail to adjust the Criminal Procedure Law to the needs of the functioning of the European Public Prosecutor's Office in Latvia.
