Surogasijas tiesiskā regulējuma problēmjautājumi atsevišķās tiesību nozarēs un Eiropas Cilvēktiesību tiesas praksē

Abstract

Bakalaura darba tēma ir „Surogasijas tiesiskā regulējuma problēmjautājumi atsevišķās tiesību nozarēs un Eiropas cilvēktiesību tiesas praksē”. Latvijas normatīvie akti šobrīd neparedz noteiktu surogasijas tiesisko regulējumu. Bakalaura darbā ir pētīta surogasija saistībā ētikas un morāles apsvērumiem, surogātmātes jēdziens, tiek analizēts atsevišķu ārvalstu surogasijas tiesiskais regulējums un Eiropas Cilvēktiesību tiesas un ārvalstu tiesu prakses atziņas. Darbā tiek aplūkota surogasija kā reproduktīvās palīgtehnoloģijas metode, tās dalībnieki, ētiskie un juridiskie problēmjautājumi. Paredzētie vecāki izvēlas izmantot surogasijas pakalpojumus, jo pastāv vēlme pēc sava bērna, kas ir bioloģiski saistīts ar vecākiem. Darbā tiek aplūkoti dažādi argumenti par un pret surogasiju. Darbā vērtēts arī tiesiskā regulējuma nepieciešamības pamatojums reproduktīvās veselības jomā Latvijā. Bakalaura darba mērķis ir pētīt surogasijas jēdzienu, ar to saistītos ētikas apsvērumus, kā arī surogasijas ietekmi uz vairākām tiesību jomām un Eiropas Cilvēktiesību tiesas sniegtās atziņas.

The topic of the bachelor's thesis is "Problems of the legal regulation of surrogacy in certain branches of law and the case law of the European Court of Human Rights". Latvian legislation currently does not set out a specific legal framework for surrogacy. The bachelor's thesis studies surrogacy in relation to ethical and moral considerations, the concept of surrogacy, analyzes the legal framework of individual foreign countries for surrogacy as well as the findings of the European Court of Human Rights and foreign court practice. Surrogacy as a method of reproductive assistive technology, its participants, ethical and legal issues are being considered in this thesis. Intended parents choose to use surrogacy services because of the desires to have their own child who is biologically related to the parents. Various arguments for and against surrogacy are being considered in the thesis. A justification of the necessity for legal framework in the area of reproductive health in Latvia is being evaluated in this thesis. The aim of the bachelor's thesis is to study the concept of surrogacy, the related ethical considerations, as well as the impact of surrogacy on several fields of law and the findings of the European Court of Human Rights.
