Sportistu procesuālās garantijas un to īstenošanas problēmas antidopinga jomā

Abstract

Pasaules Antidopinga kodekss, ietverot atsauci uz Eiropas Cilvēktiesību konvencijas 6.panta 1.punktu, nosaka minimālos procesuālo garantiju principus, kas sporta un antidopinga sistēmās ir jānodrošina sportistam pret, kuru tiek celta apsūdzība par antidopinga noteikumu pārkāpumu izdarīšanu par sankciju lemjot taisnīgā, neatkarīgā un objektīvā lietas izskatīšanas institūcijā. Bakalaura darba mērķis ir noskaidrot materiālo tiesību normas, kas veicina izpratni par sportistu procesuālajām garantijām, tai skaitā starptautiskajā praksē nostiprināto izpratnes līmeni par sportista procesuālajām garantijām antidopinga noteikumu pārkāpumu lietas izskatīšanas institūcijās, šo garantiju īstenošanu Latvijā, kā arī Latvijas normatīvā regulējuma atbilstību Satversmei. Pētījuma rezultātā autors secina, ka lai arī izpratni par sportista procesuālo garantiju iedzīvināšanu nacionālajās sporta un antidopinga sistēmās, iespējams piepildīt caur Šveices sporta tiesas judikatūru, lex sportiva, jeb sporta tiesībām, kas laika gaitā kļuvušas par būtisku tiesību avotu valstu antidopinga sistēmās, tomēr Latvijā taisnīgi un objektīvi sportistu diskvalifikācijas procesi ir jāveido atbilstoši Satversmē nostiprinātajām tiesībām un Satversmes tiesas atziņām. Problēmjautājumu risināšanai autors izvirza dažādus priekšlikumus kā, piemēram, tiesas spriešanu antidopinga noteikumu pārkāpumu lietās deleģēt specializētai tiesai, kas ir nošķirta no izpildvaras, vai kā minimums paredzēt, ka šādu institūciju nolikumiem ir jāietver kārtība, kas skaidri nosaka sportista tiesības un lietas izskatīšanas norises kārtību.

The World Anti-Doping Code, by including a reference to article 6, paragraph 1, of the European Convention on Human Rights, establishes the minimum principles of procedural guarantees. Those to be provided in sports and anti-doping systems for the athletes, against whom anti-doping rule violations have been indicted, to be sanctioned in a fair, independent and impartial trial institution. The purpose of the bachelor’s paper is to clarify the norms of substantive law which promote awareness of the procedural guarantees of athletes, including the level of understanding in international practice regarding the procedural guarantees of athletes in anti-doping hearing panels, the implementation of these guarantees in Latvia, as well as the conformity of the Latvian regulatory framework with the Constitution. As a result of the study, the author concludes that, while understanding the revitalization of the procedural guarantees of the Athlete in national sports and anti-doping systems, it is possible to fill through the Swiss sports court case law, lex sportiva, or sports law, which has become an essential source of law over time in national anti-doping systems, however, in Latvia, fair and objective athlete sanctioning processes must be established by the rights enshrined in the Constitution and the Constitutional Court's findings. To address issues, the author puts forward a variety of proposals, such as in cases of anti-doping rules violations delegating the judgment of the court to a specialized court separate from the executive authority, or providing, as a minimum, that the by-laws of such panels should include arrangements which clearly define the rights of the athlete and the procedures for the conduct of the proceedings.
