Eiropas Parlamenta deputātu nodarbinātības un deputātu izdevumu informācijas atklātības tiesiskais regulējums

Abstract

Darba mērķis ir izpētīt Eiropas Parlamenta deputātu nodarbinātības, kā arī atalgojuma un piemaksu sistēmas – ar iestādes budžeta izlietojumu (deputātu izmaksām) saistītās informācijas –atklātības tiesisko regulējumu, apzināt nepilnības spēkā esošajā informācijas atklātības tiesiskajā regulējumā un meklēt risinājumus, kā būtu pilnveidojams esošais normatīvais regulējums, lai samērotu Parlamenta deputātu tiesību aizsardzību ar lielākas caurredzamības nodrošināšanu – Eiropas Savienības pilsoņu tiesībām pietiekamā apmērā zināt, kā izlietotas dalībvalstu budžeta iemaksas Eiropas Parlamenta un tā deputātu izmaksu segšanai. Darba rezultātā autore secina, ka Eiropas Parlamenta deputātu nodarbinātības tiesiskais regulējums skaidri un pietiekami aizsargā deputātu tiesības, parlamentārās pilnvaras pildot, būt brīviem un neatkarīgiem, balsot personīgi, nesekot nekādiem norādījumiem un nepildīt saistošus uzdevumus. Taču sabiedrības iespējas kontrolēt ar deputātiem saistītās informācijas atklātību, īpaši finanšu izlietojuma caurskatāmību, ir ļoti ierobežotas – deputātu izdevumu informācijas atklātības regulējuma izvērtējums dod pamatu to uzskatīt par neefektīvu. Tomēr esošā tiesiskā regulējuma ietvarā Eiropas Parlamentam nav juridisku šķēršļu nodrošināt lielāku deputātu izdevumu informācijas atklātību, nostiprinot to normatīvā līmenī. Pētījumā izmantota gan Latvijas, gan ārvalstu juridiskā literatūra, normatīvie akti, Eiropas Savienības Tiesas prakse, kā arī dažādi informatīva rakstura materiāli. Izmantotās zinātniskās pētniecības metodes – vēsturiskā, analītiskā, salīdzinošā.

The aim of the study is to examine the employment, as well as the remuneration and the allowance systems of the European Parliament Members – via the institution's budget spending and the legal framework on the disclosure of Members’ expenses, to identify gaps in the current legal framework for information disclosure and to seek solutions on how to improve the existing regulatory framework in order to balance the protection of the Parliament Members’ rights with greater transparency: the right of the European Union citizens to know to a sufficient extent how the budgetary contributions of the Member States' are used to cover the expenditures of the European Parliament and its Members. As a result of the thesis, the author concludes that the legal framework for the employment of Members of the European Parliament clearly and sufficiently protects the rights of Members in exercising their parliamentary powers, being free and independent, voting in person, not following any instructions, or performing binding tasks. However, the public's ability to control the information transparency related to Members is very limited, especially disclosure of financial spending. The assessment of the regulation of the information transparency on Members' expenses gives grounds to consider it ineffective. Within the existing legal framework, however, there are no legal obstacles for the European Parliament to ensure greater transparency in Members' expenditure by strengthening it at a legislative level. The study uses both Latvian and foreign legal literature, regulations, the case law of the Court of Justice of the European Union, as well as various informative materials. Scientific research methods used - historical, analytical, and comparative.
