Bezdarbnieka statusa iegūšanas un saglabāšanas problemātika

Abstract

Epidemioloģiskās drošības pasākumi Covid-19 infekcijas izplatības ierobežošanai, attainoja administratīvā procesa problēmas bezdarbnieka statusa iegūšanai un saglabāšanai, ar kurām saskaras Nodarbinātības valsts aģentūra. Darbā aplūkotas saimniecisko darbības veicēju tiesības iegūt un saglabāt bezdarbnieka statusu. Autore starp pašnodarbinātām personām un patentmaksātājiem veica vienlīdzības principa analīzi, lai konstatētu vai spēkā esošais regulējums atbilst līdztiesības principam. Autore darbā ir identificējusi arī būtiskākos problēmjautājumus atsevišķām personu grupām iegūt bezdarbnieka statusu. Darbā ir pētīti un analizēti tiesu nolēmumi, Satversmes komentāri, lai analizētu, kādos gadījumos personām ir tiesības uz valsts sociālo nodrošinājumu.

Epidemiological safety measures for the containment of the spread of COVID-19 infection, address the problems of the administrative process for obtaining and maintaining the unemployment status facing the State Employment Agency. The work deals with the performers of economic activities to acquire and maintain the unemployment status. The author carried out an analysis of the principle of equality between self-employed persons and patentpayers in order to establish whether the existing legislation complies with the principle of equality. The author has also identified key issues gaining unemployment status. The work has studied and analyzed judicial rulings, Constitution comments to analyze in which cases individuals have the right to state social security.
