Piespiedu dalītā īpašuma problēmjautājumi kopš Latvijas Republikas neatkarības atjaunošanas joprojām nav zaudējuši aktualitāti. Meklējot risinājumu piespiedu dalītā īpašuma tiesiskajai noregulēšanai, likumdevējs saskaras ar vairākām problēmām, kas līdz šim liegušas iespēju rast objektīvu un juridiski korektu risinājumu piespiedu dalītā īpašuma tiesību institūta izbeigšanai un pastāvošo zemes un ēkas īpašnieku attiecību noregulēšanai. Maģistra darba mērķis ir izpētīt un analizēt piespiedu dalīta īpašuma rašanās pamatus, aktuālos problēmjautājumus, normatīvo aktu regulējumu, tiesu praksi, un sniegt iespējamos priekšlikumus piespiedu dalītā īpašuma tiesību institūta noregulēšanai. Darbs sastāv no ievada, piecām daļām, secinājumiem, izmantotās literatūras un avotu saraksta. The issue of of forced divided property have not lost their relevance since the restoration of independence of the Republic of Latvia. In seeking a solution to the legal settlement of forced divided property, the legislator faces a numer of challenges that have hitherto prevented an objective and legally correct solution to the termination of the institute of forced join ownership and the settlement of existing land – building owners. The aim of the Master’s thesis is to investigate and analyze the basics of the formation of forced shared property, current issues, regulatory enactments, jurisprudence, and to make possible proposals for settlement of the institute. The master thesis consists of an introduction, five parts, conclusion, a list of references and sources.
