Pornogrāfiska rakstura materiālu izgatavošanas un izplatīšanas noteikumu pārkāpšana

Abstract

Maģistra darbs „Pornogrāfiska rakstura materiālu izgatavošanas un izplatīšanas noteikumu pārkāpšana” veltīts Krimināllikumā noteiktajai atbildībai par noziedzīgiem nodarījumiem pornogrāfiska rakstura materiālu aprites noteikumu pārkāpšanu. Autore pēta pornogrāfiska rakstura materiālu aprites ierobežojumus, to veidus un saturu. Pornogrāfijai piemīt vairākas sabiedrībā izstrādātas pozīcijas. Personas tikumība un dzimumneaizskaramība vienmēr ir bijusi neatņemams cilvēciskās pašcieņas un pašnoteikšanās elements. Lai rastu personā ticību tiesībaizsargājošām instancēm, ir fundamentāli jaānostiprina spēcīgu tiesisko sistēmu, kas balstās uz ikvienas personas aizskarto interešu aizsardzības. Lielākajā daļā sabiedrības valda pārliecība, ka pornogrāfija ir vienlīdzīga skaidrojumā un interpretācijā ar erotiku, šā iemesla dēļ tiek aktualizēta terminu nošķiršanas nepieciešamība. Darba autores mērķis ir aktualizēt pornogrāfijas tendenču veidus, gūt ieskatu tās potenciālajai izaugsmei kā noziedzīga nodarījuma veidam, pielietojot mūsdienu informācijas tehnoloģiju tendences. Lai tiktu sasniegts darba mērķis,izvirzīti šādi darba uzdevumi, autore ir salīdzinājusi ārvalstu normatīvo regulējumu ar Latvijas normatīvo regulējumu attiecībā uz pornogrāfiska satura materiālu aprites ierobežojumiem, norobežojot to formulējumus un sniedzot priekšlikumus, kā arī izpētījusi noziedzīgā nodarījuma sastāvu. Rezultātā ir izdarīti secinājumi un izvirzīti priekšlikumi tiesisko regulējumu pilnveidošanai, izstrādes gaitā tiek piedāvāts iepazītes ar autores viedokli un argumentiem.

The master's thesis “Violation of the rules regarding the production and distribution of pornographic material” is dedicated to the liability for criminal offenses for violation of the rules for distribution of pornographic materials specified in the Criminal Law. The author studies the restrictions on the distribution of pornographic materials, their types and content. Pornography has a number of positions in society. A person's virtue and sexual integrity have always been an integral part of human self-esteem and self-determination. In order to build a person's trust in law enforcement agencies, a strong legal system based on the protection of the interests of each person must be fundamentally strengthened. The majority of the society is convinced that pornography is equal in interpretation and description with eroticism, for this reason the need to separate terms is actualized. The aim of the author of the work is to actualize the types of pornography trends, to gain an insight into its potential growth as a type of crime by applying modern information technology trends. In order to achieve the aim of the work, the author has compared the foreign regulatory framework with the Latvian regulatory framework regarding restrictions on the distribution of pornographic content, establishing their formulation and providing proposals, as well as researched the structure of the criminal offense. As a result, conclusions have been made and proposals for the improvement of legal regulations have been put forward, during in the course of this thesis, acquaintances with the author's opinion and arguments are offered.
