Maģistra darba mērķis ir izprast tiesiskas valsts principa un dubultās sodīšanas aizliegšanas principa saturu un to piemērošanu nodokļu tiesībās. Mērķa sasniegšanai Autore analizē tiesiskas valsts principu un dubultās sodīšanas aizlieguma principa piemērošanu nodokļu lietās. Kā arī vispārējo tiesību principu piemērošanas praksi Latvijas Republikas Satversmē, un principu ieviešanu administratīvajā procesā un kriminālprocesā, izskatot nodokļu strīdu lietas. Izvērtējot divkāršās sodīšanas riskus un sniedzot priekšlikums to novēršanai. Autore secina, ka nodokļu lietu jautājumu izskatīšana kriminālprocesa ietvaros un administratīvā procesa ietvaros ir pietiekoši dažāda. Tā kā normatīvo tiesību aktu regulējums starp administratīvo procesu un kriminālprocesu nodokļu strīdu lietās nav pilnībā saskaņots, pēc Autores ieskatiem, var rasties dubultās sodīšanas aizliegšanas principa pārkāpums. Tādēļ darba noslēgumā Autore piedāvā nodokļu strīdu lietu izskatīšanas harmonizāciju administratīvajā procesā un kriminālprocesā. The aim of the master's thesis is to understand the content of the rule of law and the principle of prohibition of double punishment and their application in tax law. To achieve the goal, Author analyses the application of the principles of the rule of law and the principle of prohibition of double punishment in tax cases. As well as the practice of application of general principles of law in the Constitution of the Republic of Latvia, as well as implementation of principles in administrative process and criminal proceedings when considering tax dispute cases. Assessing the risks of double punishment and making a proposal to prevent them. Author concludes that the examination of tax cases within the framework of criminal proceedings and within the framework of administrative proceedings is sufficiently different. As the regulation of regulatory enactments between administrative proceedings and criminal proceedings in tax disputes is not fully harmonized, in Author's opinion, a violation of the principle of prohibition of double punishment may occur. Therefore, at the end of the work, Author offers harmonization of tax dispute handling in administrative and criminal proceedings.
