Nevainīguma prezumpcija medijos

Abstract

Bakalaura darba temats ir “Nevainīguma prezumpcija medijos”. Temata izvēle pamatota ar nevainīguma prezumpcijas kā fundamentāla kriminālprocesa principa pastāvēšanu līdztekus mediju telpā atspoguļotajai informācijai, izvirzīti iespējamie problēmjautājumi un piedāvāti ieteikumi. Bakalaura darba mērķis ir izpētīt nevainīguma prezumpcijas principu, galvenos problēmjautājumus, mijiedarbībā ar medijos pausto informāciju, to ietekmi, iespējamiem pārkāpumiem un sekām kopsakarā ar nacionālo un Eiropas Cilvēktiesību tiesas judikatūru. Darbā tiek vērtēta mediju loma sabiedrībā, to pilnvaru robežas attiecībā uz publisku paziņojumu paušanu, kā arī ietekme uz nevainīguma prezumpcijas īstenošanu. Aplūkoti principa pārkāpumi un to ietekme uz personas reputāciju. Tāpat vērtēti tiesību doktrīnā pastāvošie viedokļi un atziņas, kā arī analizēta nacionālā un starptautiskā tiesu prakse. Darba gaitā izdarītie secinājumi un ieteikumi ir apkopoti kopsavilkumā.

The theme of Bachelor`s work is “Presumption of innocence in the media”. The choice of the theme is based on the existence of a presumption of innocence as a fundamental principle of criminal proceedings, along with the information presented in the media room, raising potential challenges and proposing recommendations. The aim of the Bachelor`s work is to explore the principle of presumption of innocence, key issues, interaction with media information, their impact, potential irregularities and consequences in relation to the case – law of the National and European Court of Human Rights. The work evaluates the role of the media in society, the limits of their powers to make public statements, and the impact on the implementation of the presumption of innocence. The infraction of the principle and their impact on the reputation of the individual are also dealt with. The opinions and findings of law doctrine and the analysis of national and international judicial practices are assessed. The conclusions and recommendations are presented in the summary.
