dc.description.abstract | Mūsdienu tehnoloģiju laikmetā personai pastāv iespējas sevi identificēt ne tikai klātienē ar personu apliecinošiem dokumentiem, bet arī attālināti, izmantojot personas apliecības funkcionalitāti. Līdz šim brīdim pase bija obligāts personu apliecinošs dokuments, savukārt personas apliecībai bija izvēles opcija. Sākot ar 2023. gada 1. janvāri personas apliecība būs obligāts personu apliecinošs dokuments, proti, ir mainījies personu apliecinošu dokumentu izsniegšanas tiesiskais regulējums, mainot personas apliecinoša dokumenta veida obligātumu. Darba mērķis ir analizēt, kā Personu apliecinošu dokumentu likums un tā grozījumi, ka arī citi normatīvie akti personu apliecinošu dokumentu jomā ierobežo personu cilvēktiesības, analizēt cilvēka tiesības tikt atzītām par personu un personu apliecinoša dokumenta nozīme šo tiesību īstenošanā. Pētījuma rezultātā konstatētas pašreizējā tiesiskā regulējuma nepilnības un trūkumi, veikta pamattiesību ierobežojumu analīze atbilstoši Satversmes tiesas un Eiropas Cilvēktiesību tiesas izmantotajai ierobežojumu pārbaudes shēmai. | |
dc.description.abstract | In today's age of technology, a person has the opportunity to identify himself / herself not only in person with identity documents, but also remotely using the functionality of the identity card. Until now, a passport was a mandatory identity document, while an identity card was an option. As of January 1, 2023, the identity card will be a mandatory identity document, namely the legal regulation of the issuance of identity documents has changed, changing the mandatory nature of the type of identity document. The aim of the work is to analyze how the Law on Identity Documents and its amendments, as well as other regulatory enactments in the field of identity documents restrict the human rights of persons, to analyze the human right to be recognized as a person and the role of an identity document in the implementation of these rights. As a result of the research, the shortcomings of the current legal regulation have been identified, the analysis of restrictions on fundamental rights has been performed in accordance with the restriction inspection scheme used by the Constitutional Court and the European Court of Human Rights. | |
