Sabiedriskais darbs kā brīvības atņemšanas sodu alternatīva

Abstract

Bakalaura darba tēma ir “Sabiedriskais darbs kā brīvības atņemšanas alternatīva”. Darbā autore izmanto jauno soda veida nosaukumu, kas Krimināllikumā stāsies spēkā 2022. gada 1. janvārī. Bakalaura darba temats ir aktuāls tā kā sabiedriskais darbs salīdzinājumā ar citiem Krimināllikumā paredzētajiem soda veidiem ir ieviests salīdzinoši nesen. Darba temata aktualitāti autore pamato arī ar grozījumu gaidāmo spēkā stāšanos Krimināllikumā, kas, galvenokārt, paredz soda veida nosaukuma maiņu, kā arī nelielas izmaiņas sabiedriskā darba piemērošanā. Bakalaura darba mērķis ir izpētīt sabiedriskā darba vēsturisko attīstību, piemērošanu, izpildi, izpētīt, kādas izmaiņas paredz Krimināllikuma grozījumi, kas stāsies spēkā 2022. gada 1. janvārī, kā arī noskaidrot un izpētīt, kā sabiedriskais darbs kā brīvības atņemšanas alternatīva ir ietekmējis brīvības atņemšanas piemērošanu. Darba uzdevums bija izpētīt normatīvos aktus, kas regulē sabiedriskā darba piemērošanu, izpētīt Krimināllikuma vēl spēkā nestājušos grozījumus, kā arī izpētīt sabiedriskā darba un citu soda veidu piemērošanas statistiku pēc sabiedriskā darba ieviešanas Krimināllikumā.

The topic of the Bachelor’s thesis is “Community service as an alternative to imprisonment”. In this thesis the author uses the new name of this type of punishment which will come into force in Criminal law on January 1, 2022. The topic of the Bachelor’s thesis is relevant because as community service in comparison with other types of punishment has been implemented relatively recently. The author also reasons relevance of the topic of this thesis with the amendments to the Criminal law that have not come into force yet, which mainly envisages to change the name of this type of punishment as well ass ome small changes in the imposition of community service. The aim of the Bachelor’s thesis is to research the historical development, application and execution of the community service and to research what changes are envisaged by the amendments to the Criminal law that will come into force on January 1, 2022 as well to research how community service has impacted the imposition of imprisonment. The task of the thesis was to research the regulations that govern the imposition of community service, to research the amendments to the Criminal law that have not come into force yet, as well as to research the statistics of imposition of community service and other types of punishment after community service was enacted in the Criminal law.
