Krāpšana darījumos

Abstract

Bakalaura darbā “Krāpšana darījumos” autore pēta krāpšanas, kas izdarīta ar viltu, specifiku tiesiskajos darījumos, kuru pamatā ir gribas defekts maldības formā. Krāpšana ir viens no praksē visbiežāk pieļautajiem noziedzīgajiem nodarījumiem, taču pastāv neskaidrība atsevišķu tās kvalificējošo pazīmju noteikšanā. Tiesību praksē pastāv gadījumi, kuros novērojamas grūtības nošķirt krimināltiesisku viltu no civiltiesiska viltus. Nošķiršanas kritēriji būtiski ietekmē piemērojamās atbildības veidu un apmēru. Krāpšana var ietekmēt gan cietušā likumiskās intereses, gan, tostarp trešo personu – labticīgo ieguvēju, tāpēc bakalaura darba ietvaros papildus tiks apskatīta nekustamā īpašuma izkrāpšana un ar to saistītās aktualitātes. Bakalaura darba mērķis ir noskaidrot kritērijus, pēc kuriem bez sarežģījumiem ir iespējams noteikt īpatnības krāpšanas sastāvā, civiltiesiskā un krimināltiesiskā normatīvā regulējuma ietekmi uz krāpšanas prevenciju un noteikt krāpšanas un civiltiesiska viltus robežas. Pirmajā darba nodaļā autore apskatīs krāpšanu kā mantas nolaupīšanas veidu un tās vēsturisko izcelsmi. Otrajā nodaļā autore aprakstīs krāpšanas sastāva pazīmes. Trešajā nodaļā autore pētīs īpatnības nekustamo īpašumu izkrāpšanā. Ceturtajā nodaļā tiks analizēta krimināltiesiska viltus, kas ir viens no krāpšanas realizācijas veidiem, nošķiršanas pazīmes no civiltiesiska viltus, tostarp civiltiesiskas atbildības.

In the Bachelor paper “Fraud in Transactions”, the author studies the specific nature of criminal deceit in legal transactions based on a defect of will in the form of deception. Fraud is one of the most frequently committed crimes, although there is uncertainty in identifying some of its qualifying features. There are cases in legal practice where are difficulties in distinguishing criminal deceit from the deceit of civil law. The criteria of separation have a significant impact on the nature and extent of the applicable liability. Fraud may influence the legal interests of the victim and, inter alia, the third-party – the lawful possessor. Therefore, as an additional part of the Bachelor paper the author will analyse the fraud of real estate and the related topics. The Bachelor paper aims to clarify the criteria by which it is uncomplicated to determine the specific elements of fraud, the impact of civil and criminal legislation on the prevention of fraud as well as to set limits for fraud and civil deceit. In the first section of the Bachelor paper, the author will look at fraud as a form of property abduction and its historic origins. In the second chapter, the author will describe the specific elements of fraud. In the third section, the author will study the distinct features of real estate fraud. The fourth chapter will cover the analysis of the peculiarities of separation of criminal deceit, which is one of the ways of committing fraud, and civil deceit, including civil liability.
