Dāvanu pieņemšanas ierobežojums kā garants tiesneša objektivitātei

Abstract

Bakalaura darbā “Dāvanu pieņemšanas ierobežojums kā garants tiesnešu objektivitātei” darba autore pēta regulējumu dāvanu pieņemšanas ierobežojumiem. Darbā apskata jautājumus par tiesībām uz taisnīgu tiesu, tiesnešu (tiesas) objektivitātes un neatkarības jēdzienus, un to saturu tiesnešu ētikas kodeksā un normatīvajos aktos. Skatīts arī jautājums, kas ir dāvanas, un kāda ir to pasniegšanas nozīme, dāvanu pasniegšanas ierobežojumu saturs, to normatīvais regulējums. Tiek salīdzināts Latvijas normatīvais regulējums ar Baltijas valstu normatīvo regulējumu par dāvanu pieņemšanas ierobežojumu, darba autore secina, ka visās trijās valstīs ir vienota nostādne šajā jautājumā. Autore uzskata, ka dāvanu pieņemšanas ierobežojuma regulējums tiesnešiem ir atbilstošs, un šis regulējums, galvenokārt, tiek īstenots balstoties uz tiesnešu lojalitāti savam amatam un ētisko normu ievērošanu.

In the bachelor's work "Restriction on accepting gifts as a guarantee of a judges' impartiality", the author studies the regulation of gift acceptance restrictions. The paper examines the issues of the right to a fair trial, the concepts of impartiality and independence of judges (courts), and their content in the code of ethics of judges and regulatory enactments. The question of what gifts are and what is the meaning of their presentation, the content of restrictions on the presentation of gifts and their normative regulation is also considered. The regulatory framework of Latvia is compared with the regulatory framework of the Baltic States regarding the restriction of gift acceptance, The author concludes that all three countries share a common framework on this issue. The author considers that the regulation of the restriction on the acceptance of gifts for judges is appropriate, and this regulation is mainly implemented on the basis of judges' loyalty to their position and observance of ethical norms.
