Cilvēka cieņas aizsardzība sociāli atbildīgā valstī

Abstract

Diemžēl nav vienprātīgi secināts ne cilvēka cieņas koncepta saistošais raksturs, ne tā saturs. Arī sociālo tiesību normas, tai skaitā izglītības jomā, valsts bieži uztver vien kā deklaratīvas. Darba mērķis ir noskaidrot pienākumu apjomu, kas valstij izriet no cilvēka cieņas un sociāli atbildīgas valsts principa, tēmu sašaurinot un skatot izglītības tiesību kontekstā. Mērķa sasniegšanai izvirzīti tādi uzdevumi kā noskaidrot cilvēka cieņas un sociāli atbildīgas valsts principa saistošo raksturu un saturu, kā arī no tā izrietošo tiesību apjomu izglītības tiesībās. Pētījuma rezultātā autore secina, ka minētie principi valstij uzliek reālus pienākumus sociālo tiesību jomā un nav uzskatāmi vien par abstraktiem mērķiem.

Neither the binding nature nor the content of the concept of human dignity is unanimously concluded. The norms of social law often perceived by the state only as declarative. The aim of the work is to find out the scope of obligations to the state arising from human dignity and the principle of a socially responsible state, considering it in the context of educational rights. In order to achieve the goal of the research, such tasks have been set as the elucidation of the content and binding force of human dignity and principle of the socially responsible state and the scope of the resulting right to education. The author concludes that the mentioned principles impose real obligations on the state in the field of social rights and cannot be considered as mere abstract goals.
