Pašaizsargājošās demokrātijas princips Latvijas tiesiskajā sistēmā

Abstract

Pašaizsargājošā demokrātija ir jēdziens, kas kopš tā parādīšanās pirmo reizi 1937. gadā rada daudzus jautājumus, ņemot vērā tā brīža problēmas, kā arī turpmākos izaicinājumus demokrātijai. Tomēr Latvijā pašaizsargājošā demokrātija ir pētīta fragmentāri vai uztverta kā pašsaprotama. Darba mērķis ir noskaidrot pašaizsargājošās demokrātijas principa saturu Latvijas tiesiskās sistēmas ietvaros. Tādēļ bakalaura darbā autore noskaidro pašaizsargājošās demokrātijas izpratni, pēta pašaizsargājošās demokrātijas principa vietu Latvijas tiesiskajā sistēmā un analizē pašaizsargājošās demokrātijas principa saturu caur Latvijas tiesību avotiem.

Democracy capable of defending itself (more known as militant democracy) is a concept, which raises many questions since its first appearance in 1937 considering the problems of the time as well as the further challenges to the democracy. However, in Latvia democracy capable of defending itself has been studied fragmentarily or considered as self-evident. The aim of the bachelor's thesis is to identify the content of the principle of democracy capable of defending itself within the Latvian legal system. The author identifies the understanding of democracy capable of defending itself, studies the place of the principle in the Latvian legal system and analyses the content of the principle through Latvian legal sources.
